BOARDS AND COMMISSIONS: Stadium Advisory Board – Appointment by the Mayor; Receipt of information by Council Mayor Williams will recommend an individual for appointment to the Stadium Advisory Board. PROCLAMATION WHEREAS, our Founding Fathers, including South Carolinians, Pierce Butler, Charles Pinckney, John Rutledge, and Charles Cotesworth Pinckney, risked their fortunes, and some even their lives, to secure the blessings of liberty for themselves and their posterity, did ordain and establish a Constitution for the United States of America; and WHEREAS, September 17, 2026, marks the two hundred and thirty-ninth anniversary of the drafting of the Constitution of the United States by the Constitutional Convention; and WHEREAS, the anniversary of the signing of the Constitution provides an historic opportunity for all Americans to learn about and recall the achievements of our Founders, and to reflect on the rights and privileges of citizenship as well as its attendant responsibilities; and WHEREAS, the independence guaranteed to the American people by the Constitution should be celebrated by appropriate ceremonies and activities during Constitution Week, September 17 through 23, 2026, as designated by proclamation of the President of the United States of America in accordance with Public Law 915. NOW THEREFORE, I, Briton S. Williams, Mayor City of North Augusta ATTACHMENT #5a Page 1 of 1 PROCLAMATION WHEREAS, polluted water released into our local creeks, streams, reservoirs, and rivers can cause harm to human health and wildlife, contaminate our drinking water sources, and threaten the ability to take part in recreational water activities; and WHEREAS, population growth, residential and commercial development, and the resulting changes to the natural drainage and hydrology of the land will only deepen our concern for stormwater quantity and quality in the City of North Augusta; and WHEREAS, the most common source of pollution to our water resources is stormwater runoff that includes yard waste, pet waste, vehicle fluids, trash, and sediment; and WHEREAS, these impacts cannot be entirely avoided, or eliminated, but can be reduced with the use of education, outreach, and change in everyday pollution prevention practices; and WHEREAS, our Stormwater Management Department is equipped to aid in the development and implementation of effective education and outreach programs in connection with other municipalities and organizations within the CSRA, that will meet state and federal stormwater pollution control requirements; and WHEREAS, this need arises from regulatory requirements, but also from the local community members, residents of our City, and local stakeholders and decision makers that will benefit from a greater awareness of the cumulative impacts our decisions make at home, at work, at school, and through local policy, effect the water quality of the Savannah River and our local water resources; and WHEREAS, the year 2026 marks the 5th annual Stormwater Awareness Week sponsored in the City of North Augusta. NOW THEREFORE, I, Briton S. Williams, Mayor City of North Augusta ATTACHMENT #5b Page 1 of 1 ORDINANCE NO. 2026-17 AMENDING SECTION 9.6 RELATED TO MAXIMUM WALL SIGN AREA ALLOWABLE IN MULTI-TENANT PROPERTIES OF THE NORTH AUGUSTA DEVELOPMENT CODE, ARTICLE 9 OF CHAPTER 18 OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA CODE OF ORDINANCES WHEREAS, on December 18, 2023, by Ordinance 2023-32, the North Augusta City Council adopted the North Augusta Development Code which is consistent with the City’s Comprehensive Plan and which incorporates all City zoning and land development regulations; and WHEREAS, pursuant to Section 18.11.2 Text Amendments in Article 18, Administration and Enforcement, of the North Augusta Development Code, any person, property owner, board, commission, department or the City Council may apply for a change in zoning ordinance text; and WHEREAS, on August 10, 2026 the Planning Department received a request from the Planning and Development Department for a text amendment to amend the maximum sign area allowable in multi-tenant properties; and WHEREAS, the North Augusta Planning Commission, following an August 19, 2026, public hearing, reviewed and considered a request to amend Section 9.6.2 to add wording, “Except, where a single parcel contains more than one business, each business may have a front wall sign not exceeding 10% of the square-footage of tenant front façade. Where the tenant square footage would allow more than 250 square-feet of signage, the main sign is limited to no more than 250 square-feet.” Also, to delete Section 9.6.4.3 titled Shopping Centers. The Planning Commission report has been provided to City Council for consideration; and WHEREAS, The Mayor and City Council have reviewed the request as well as the report from the Planning Commission and has determined that the change to the text of the Development Code is appropriate. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: I. The North Augusta Development Code, Article 9 is amended and shall read as described in the following section. Prepared by: Tommy Paradise Meeting Date: August 19, 2026 Section 1 Project Name Shopping Center Signs Applicant City of North Augusta Proposed Text Amendment A request from the Board of Zoning Appeals for the Planning Commission to review allowable signage for Shopping Centers. Planning Commission reviewed and recommends amending Section 9.6.2 and deleting Section 9.6.4.3 Section 2: General Description In December 2023, a new North Augusta Development Code (NADC) was adopted. Section 9.6.4.3 regulates the allowed signage in a shopping center and in particular limits the area to 1,000 sq. ft. of floor area. After several variance requests were heard by the Board of Zoning Appeals (BZA), the BZA requested the Planning Commission to review the requirements. The Planning Commission discussed in several meetings and proposed to amend Section 9.6.2 to read “Signage Allowed By District. The following sign types are allowed by zoning district, subject to any additional provisions of this article. Maximum Total Signage Allowed by District. Table 9.3 outlines the total combined square footage allowed by lot for non-residential districts. Except, where a single parcel contains more than one business, each business may have a front wall sign not exceeding 10% of the square-footage of tenant front façade. Where the tenant square footage would allow more than 250 square-feet of signage, the main sign is limited to no more than 250 square-feet.” It was also recommended to delete Section 9.6.4.3 Section 3: Planning Commission Consideration The Planning Commission is being asked to review the request for a text amendment based on the following provisions of the North Augusta Development Code: 17.4.1 Authority Under This Article. The Planning Commission (Commission) shall have all the powers and duties as assigned by §6-29-340 of the South Carolina Local Government Comprehensive Planning Enabling Act (Title 6) to be carried out in accordance with these regulations as detailed in Article 17 and in the adopted Rules of Procedure for the Commission. ATTACHMENT #6 - P&D INFORMATION Page 1 of 4 Project Staff Report RZT26-002 Amend Shopping Center Sign Prepared by Tommy Paradise Meeting Date: August 19, 2026 In addition, the Commission shall have any other power or duty as assigned by the City Council in conformity with Title 6. 6-29-340 South Carolina Code of Laws. Functions, powers, and duties of local planning commissions. (B) In the discharge of its responsibilities, the local planning commission has the power and duty to: (2) prepare and recommend for adoption to the appropriate governing authority or authorities as a means for implementing the plans and programs in its area: (a) zoning ordinances to include zoning district maps and appropriate revisions thereof, as provided in this chapter; 18.11 Rezoning and Text Amendments This section applies to any application for an amendment to the text of this Chapter or for an amendment to the Official Zoning Map, also known as a “rezoning.” Such amendments must be submitted to the Planning Commission for review and recommendation to City Council, who may then vote to amend the Chapter or Official Zoning Map. Appropriate application forms for text amendment or rezoning shall be provided by the Director of Planning or his designee. A pre- application conference is recommended before the application is submitted to discuss the procedures and requirements for the amendment request and identify the submittal requirements. 18.11.2 Text Amendment. Any person, property owner, board, commission, department, or the City Council may apply for a change in the zoning ordinance text. Such amendment may be initiated by filing an application per the requirements of the City’s Administrative Manual with the Department. The application shall be signed by the applicant and shall include the language of the proposed amendment to the text of this Chapter and the justification for the proposed change. 18.11.3 Application Review. The Department shall complete a review of the application and determine if the application is complete. If the application is incomplete, it will be returned to the applicant. If the application is complete, the Planning Director shall review the request and create a written recommendation for Planning Commission and Council consideration. The Director may forward the request to the Technical Review Committee for additional review and information. 8.11.4 Decision. The Director shall transmit the application for zoning amendment or rezoning to the Planning Commission at its next regularly scheduled monthly meeting, provided the complete application is submitted at least 30 calendar days prior to the meeting. The Planning Commission shall approve or deny the zoning amendment in accordance with the procedures for a legislative hearing as provided in the City’s Administrative Manual and the S.C. Code §6-29- 760. ATTACHMENT #6 - P&D INFORMATION Page 2 of 4 Project Staff Report RZT26-002 Amend Shopping Center Sign Prepared by Tommy Paradise Meeting Date: August 19, 2026 1. The Planning Commission shall submit its recommendation to City Council within 30 calendar days after the initial hearing date (S.C. Code §6-29760(A). A majority vote is required for the Planning Commission to approve, approve with conditions (if applicable), or deny a rezoning or text amendment application. 2. The City Council shall consider the recommendation of the Planning Commission and staff on each proposed rezoning and text amendment within 30 days of receipt of the Planning Commission recommendation. The City Council must consider, but is not bound by, the Planning Commission recommendation in making a final decision and may call for additional information or public hearing(s). 3. No challenge to the adequacy of notice or to the validity of a rezoning or text amendment may be made 60 days after the decision of the City Council if there has been substantial compliance with the notice requirements of this section, with the established procedures of the City Council and Planning Commission, and with S.C. Code §6-29. The Planning Commission is being asked to review the proposed text changes and provide a recommendation of approval or denial, which will be forwarded to the City Council. Section 18.11 does not require additional standards for analysis to address in this staff report. Section 4: Public notice A public notice of the text amendment request and scheduled date of the Planning Commission public hearing was published in the North Augusta Star and on the City’s website www.northaugustasc.gov on January 28, 2026. Section 5: History The North Augusta Development Code that was adopted by City Council on December 17, 2007, effective January 1, 2008, was repealed and replaced by the North Augusta Development Code adopted by City Council on December 18, 2023. The 2023 Development Code is consistent with the Comprehensive Plan Update of 2022. Public comments were solicited through formal public hearing and informal communication throughout the multiyear development of the code. The North Augusta Planning Commission recommended approval of a draft Development Code and referred to City Council on June 6, 2023. City Council, in accordance with Section 6-29-760 of the South Carolina Code of Laws, held a public hearing on September 11, 2023. Based on information from the public hearing, the Development Code draft was referred back to the Planning Commission for further recommendations. At the October 18, 2023 Planning Commission meeting the Commission heard public input and reviewed issues that were heard in Council’s public hearing. At the November 15, 2023 meeting of the Planning Commission, the Commission recommended a revised draft for adoption by City Council. City Council adopted this draft at their December 18, 2023 meeting. The application also recommends deleting Section 9.6.4.3 ATTACHMENT #6 - P&D INFORMATION Page 4 of 4 ORDINANCE 2026-18 AUTHORIZING THE CONVEYANCE OF CERTAIN REAL PROPERTY AND TEMPORARY CONSTRUCTION EASEMENTS TO THE SOUTH CAROLINA DEPARTMENT OF TRANSPORTATION IN CONNECTION WITH PROJECT P043867, THE SR 4/US 25 BUSINESS BRIDGE REPLACEMENT OVER THE SAVANNAH RIVER WHEREAS, the South Carolina Department of Transportation (“SCDOT”) is undertaking Project P043867 for the replacement of the SR 4/US 25 Business bridge over the Savannah River and associated roadway improvements; and WHEREAS, SCDOT has identified certain property owned by the City of North Augusta that is necessary for the construction and completion of the project; and WHEREAS, SCDOT has requested that the City convey temporary construction/right-of-way easements over portions of City-owned property identified as Tracts 008, 011, 012, 013, 014, 015, and 015A; and WHEREAS, the temporary easements will revert to the City upon completion and acceptance of the project in accordance with the applicable conveyance documents; and WHEREAS, SCDOT has also requested the acquisition in fee simple of approximately 1,153.19 square feet (0.026 acres) of City-owned property identified as a portion of Tract 008; and WHEREAS, SCDOT has offered total compensation of Fifty Thousand Four Hundred Dollars ($50,400.00) for the temporary easements and fee-simple acquisition; and WHEREAS, City Council finds that the requested conveyances are appropriate and in the public interest and desires to authorize their execution. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, that: I. The City Administrator and other appropriate City officials are authorized to take such further actions as may be reasonably necessary to complete the transactions authorized herein, provided that any non-material modifications to the conveyance documents shall be subject to review and approval by the City Attorney. Williams, Mayor ATTEST: Jamie Barton, City Clerk ATTACHMENT #7 Page 2 of 2 ORIDNANCE NO. 2026-19 AMENDING ARTICLE V, DIVISION III, SECTIONS 14-170.2 AND 14-170.3 TITLED “STORMWATER MANAGEMENT PERMIT REQUIRED; EXCEPTIONS” AND “APPLICATION, REVIEW AND APPROVAL, AND ISSUANCE OF STORMWATER MANAGEMENT PERMIT” OF THE CITY CODE OF NORTH AUGUSTA, SOUTH CAROLINA WHEREAS, the City of North Augusta’s Stormwater Management Department underwent an audit from the South Carolina Department of Environmental Services (SCDES) on February 26, 2026; and WHEREAS, SCDES provided comments as a result of the audit on May 6, 2026; and WHEREAS, SCDES requested changes to the City of North Augusta’s Stormwater Ordinance; and NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof that: I. Article V, Section 14-170.2, titled "Stormwater management permit required; exceptions." is hereby amended and when amended shall read as follows: ARTICLE V. STORMWATER MANAGEMENT Section 14-170.2. - Stormwater management permit required; exceptions (a) The surface of land in the city shall not be disturbed or altered for any purpose whatsoever until a stormwater management permit is issued to the person responsible for such construction. No permit shall be issued until the applicant has submitted a plan to control erosion and sedimentation and such plan has been approved by the City Engineer or their designated representative. Unless otherwise exempt in section (b) below, construction activity is prohibited from commencing until the person(s) responsible for construction receives a permit and written approval of the plans. Additional permits required, must be acquired prior to start of construction. II. Article V, Section 14-170.3, titled "Application, review and approval, and issuance of stormwater management permit." is hereby amended and when amended shall read as follows: ARTICLE V. STORMWATER MANAGEMENT Section 14-170.3. - Application, review and approval, and issuance of stormwater management permit. (a) Application. All applications for stormwater management permits shall be submitted to the stormwater management department (SWMD) through the planning and development department for processing and permit issuance. Applications for permits shall be accompanied by three (3) copies of the applicants stormwater and erosion control plan. Stormwater and erosion control plans shall conform to the requirements of the ordinance for stormwater and erosion control plans requirements. (c) Review and approval. The SWMD will review each application for a stormwater management permit to determine its conformance with the provisions of this regulation. ATTACHMENT #8 Page 1 of 2 Within thirty (30) working days after receiving an application deemed to be complete by planning and development procedure, the SWMD shall, in writing: (1) Approve the permit application; (2) Approve the permit application subject to such reasonable conditions as may be necessary to secure substantially the objectives of this regulation, and issue the permit subject to these conditions; or (3) Disapprove the permit application, indicating the deficiencies and the procedure for submitting a revised application and/or submission. Failure of the SWMD to act on original or revised applications within thirty (30) working days of receipt shall authorize the applicant to proceed in accordance with the plans as filed unless such time is extended by agreement between the applicant and the SWMD. III. This Ordinance shall become effective immediately upon its adoption on second and final reading. IV. All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
