AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, AND
EDGEFIELD COUNTY, SOUTH CAROLINA, FOR THE COLLECTION OF
DEVELOPMENT IMPACT FEES
WHEREAS, the City of North Augusta ("City") is a municipal corporation organized and
existing under the laws of the State of South Carolina; and
WHEREAS, Edgefield County ("County") has adopted, or intends to adopt, a Development
Impact Fee Ordinance pursuant to the South Carolina Development Impact Fee Act, S.C. Code
Ann. §§ 6-1-910 through 6-1-1080, as amended; and
WHEREAS, Section 6-1-1070 of the South Carolina Code authorizes governmental
entities to enter into intergovernmental agreements for the collection of development impact fees
and for the expenditure of such fees by the governmental entity responsible for providing the public
facilities and services for which the fees are imposed; and
WHEREAS, portions of Edgefield County are located within the City's planning and
permitting jurisdiction, and development within these areas creates impacts on public facilities
identified in the County's Capital Improvements Plan; and
WHEREAS, the City and County desire to cooperate in an efficient and uniform manner
by providing for the collection of County development impact fees at the time development
permits are issued by the City; and
WHEREAS, the proposed Intergovernmental Agreement establishes the procedures for
collecting, remitting, accounting for, and administering such impact fees while preserving the
authority of the County regarding the expenditure of the fees; and
WHEREAS, the City Council finds that entering into the Intergovernmental Agreement
promotes intergovernmental cooperation, enhances administrative efficiency, ensures compliance
with state law, and serves the public health, safety, and welfare.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
North Augusta, South Carolina, in meeting duly assembled, that:
Section 1. Approval of Agreement.
The Intergovernmental Agreement between the City of North Augusta and Edgefield County for
the collection of development impact fees is hereby approved in substantially the form presented
to City Council.
