Freitas, Councilmember ORDER OF BUSINESS STUDY SESSION The Study Session of November 24, 2025 for the City Council of the City of North Augusta, having been duly publicized, was called to order by Mayor Williams at 6:00pm and also streamed online for public viewing at the City Facebook page: “City of North Augusta – Public Information” and City YouTube page: “City of North Augusta Public Information.” Per Section 30-4-80(e) notice of the meetings was sent out by email to the current maintained “Agenda Mailout” list consisting of news media outlets and individuals or companies requesting notification. Notice of the meetings was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Members present were Mayor Williams, Councilmembers Briatico, Buck, Carpenter, Felak, Freitas, and Toole. Also in attendance were J.D. McCauley, Assistant Administrator; Kelly F. Zier, City Attorney; Chief Junior Johnson, Public Safety; James Sutton, Director of Public Services; Kayla Ferguson, Manager of Human Resources; and Ricky Jones, Manager of Information Technology. ITEM 1. CITY COUNCIL MEETING: Assistant Administrator McCauley led Council’s discussion of items for the December 1, 2025 regular meeting. (See Attachment #1) ITEM 2. ATTACHMENT #3Aii Page 3 of 12 Golf Cart Ordinance State Requirements •All golf carts must have permit decal and registration certificate from the Department of Motor Vehicles. •Must have proof of ownership, proof of liability insurance, and pay a $5 DMV fee. •Driver must be 16 years of age and have a valid driver’s license. •The following must be in their possession when operating the golf cart •The registration certificate, proof of liability insurance, and driver’s license. •Each golf cart passenger under the age of 12 must wear a seatbelt when operated on a roadway. ATTACHMENT #3Aii Page 4 of 12 Golf Cart Ordinance Allowed Changes •A municipality may set the following: •Hours, methods, and locations of golf cart operations (Golf carts may be operated only on a highway where the speed limit is 35 mph or less) •Permit the operation of golf carts at night (Golf carts must be equipped with working headlights and taillights, and Golf carts may be operated only on a highway where the speed limit is 35 mph or less) ATTACHMENT #3Aii Page 5 of 12 Golf Cart Ordinance Allowed Changes •Permit operation on the shoulder of primary highways, secondary highways, streets and roads, designate separate golf cart paths for the purpose of golf cart transportation. •Municipality must obtain necessary approvals to create golf cart paths. •The golf cart path must be separated from the traffic lanes by a hard curb or parking spaces or separated from the traffic lanes by a distance of four feet or more. ATTACHMENT #3Aii Page 6 of 12 Golf Cart Ordinance Take No Action •All state requirements covered earlier apply •Operated during daylight hours •Only on a secondary highway where the speed limit is 35mph or less •Operated within four miles of an address •Cross a highway at an intersection where the speed limit is 35 mph or less •Alcohol violations apply to a golf cart just as they do a vehicle(DUI, Open container, etc.) ATTACHMENT #3Aii Page 7 of 12 Golf Cart Ordinance Other Municipalities •Tega Cay allows for all night operation •Goose Creek allows for all night operation •Conway allows for operation until 11pm •North Myrtle Beach allows golf carts from sunup to sundown •Source: Post and Courier ATTACHMENT #3Aii Page 8 of 12 Golf Cart Ordinance Recommendations •Language in ordinance that meets all state requirements •Permit operation only on secondary highway with a speed limit 35 mph or less •Golf carts may cross streets or highways at intersections even if the cross street has a higher speed limit •Operation is permitted within 4 miles of the address of registration ATTACHMENT #3Aii Page 9 of 12 Golf Cart Ordinance Recommendations •Golf carts may be operated after sunrise to 11pm if the golf cart is equipped with the following: •Headlights, taillights, brake lights, reflectors(front, rear, and sides), and a rear facing mirror •Nighttime operation is prohibited during conditions of poor visibility unless the vehicle is equipped with a functional windshield and wipers. •The city may restrict nighttime golf cart operation in specific areas through signage or future ordinance amendments.
