Toole, Councilmember ORDER OF BUSINESS The Public Power Hour was streamed for public viewing online at: “City of North Augusta – Public Information” on www.Facebook.com and “City of North Augusta Public Information” on www.YouTube.com. PUBLIC POWER HOUR The November 4, 2024 Public Power Hour began at 5:30pm. Members present were Mayor Williams, Councilmembers Buck, McCauley, McGhee, and Presnell. Members absent was Councilmember Carpenter and Toole. Also, in attendance were Ricky Jones, Manager of Information Technology and Jamie Paul, City Clerk. 1. Karen Fralick spoke on resurfacing of tennis courts at Riverview park. (See Attachment PPH#1) 2. Tyler Galles, representative of Friends of the North Augusta Animals, spoke on vet care needs at the North Augusta Animal Control. (See Attachment PPH#2) The Public Power Hour concluded at 5:59pm. Page 2 of 5 REGULAR MEETING The Regular meeting of the City Council of the City of North Augusta of November 4, 2024 having been duly publicized was called to order by Mayor Williams at 6:02pm and also streamed online for public viewing at “City of North Augusta – Public Information” on www.Facebook.com and on the “City of North Augusta Public Information” on www.YouTube.com. Per Section 30-4-80, (e) notice of the meeting by email was sent out to the current maintained “Agenda Mailout” list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Williams rendered the invocation and the Pledge of Allegiance. Members present were Mayor Williams, Councilmembers Buck, McCauley, McGhee, and Presnell. Members absent were Councilmembers Carpenter and Toole. Also in attendance were James S. Clifford, City Administrator; J.D. McCauley, Assistant Administrator; Chief Junior Johnson, Director of Public Safety; Rick Meyer, Director of Parks and Recreation; Jennifer Goldman, Tourism and Marketing Coordinator; Ricky Jones, Manager of Information Technology; and Jamie Paul, City Clerk. Items on the agenda were discussed out of order, but for the purpose of clarity will remain as listed on the agenda. ITEM 4. APPROVAL OF MINUTES: The minutes of the City Council Meeting of October 21, 2024, Special Called City Council Meeting of October 28, 2024, and Study Session of July 29, 2024, were approved as submitted by general consent. ITEM 5. PERSONNEL: a. Employee of the Quarter – July, August, and September 2024 – Ed Galo Mayor Williams recognized Officer Ed Galo as employee of the quarter. He stated that Ed is a great employee who comes to work with a positive attitude that infects everyone around him. Ed is not only great at his daily duties but constantly volunteers for additional shifts when help is needed. Ed is always willing to help anyone he can and being bilingual often helps with translations. One example is recently with a missing juvenile case, Ed was able to assist the Investigations Division with translation as almost no one involved spoke English. Investigations relayed that this was very helpful with their investigation as he was able to translate in real time and also help bridge the cultural gap. Much of this was done on his days off but he remained committed to helping ensure, along with Investigations that the child was found safely. Ed is an asset to Public Safety as well as the city as a whole. Page 3 of 5 ITEM 6. PROCLAMATION(S): a. World Pancreatic Cancer Day – November 21, 2024 Mayor Williams read the World Pancreatic Cancer Day – November 21, 2024 proclamation and presented the proclamation to Kathleen Sherrill, PanCAN South Carolina Affiliate Member. (See Attachment #6a) b. Small Business Saturday – November 30, 2024 Mayor Williams read the Small Business Saturday – November 30, 2024 proclamation and presented the proclamation to Ralph Porter, Chairman of the Business Development Council and other small businesses within the City. (See Attachment #6b) NEW BUSINESS ITEM 7. ELECTION: Ordinance No. 2024-24 Complying with Sections 10-1 and 10-2 of the Code of Laws of North Augusta, South Carolina, by Setting the Dates for Municipal Party Primaries, Conventions, and Partisan General Election and Special Election, Times for Filing of Nominating Petitions, Certification of Candidates by Parties, and Certification of Candidates by Municipal Election Commission – First Reading Public Comment: John Felak, Chairman of a Republican party, inquired on the primary election date, which was clarified and noted that the Primary Election would be on February 11, 2025. Administrator Clifford stated that item #’s 7 and 8 are linked and required for the City election. It was moved by Councilmember Presnell, seconded by Councilmember McGhee, to approve Ordinance No. 2024-24 Complying with Sections 10-1 and 10-2 of the Code of Laws of North Augusta, South Carolina, by Setting the Dates for Municipal Party Primaries, Conventions, and Partisan General Election and Special Election, Times for Filing of Nominating Petitions, Certification of Candidates by Parties, and Certification of Candidates by Municipal Election Commission – First Reading. ELECTION: Ordinance No. 2024-25 To Partner with the Aiken County Board of Registration and Elections to Conduct a Portion of the 2025 City of North Augusta Municipal General Election and Special Election – First Reading No public comment. It was moved by Councilmember McCauley, seconded by Councilmember Presnell, to approve Ordinance No. 2024-25 To Partner with the Aiken County Board of Registration and Elections to Conduct a Portion of the 2025 City of North Augusta Municipal General Election and Special Election – First Reading. Unanimously Approved. (See Attachment #7) Page 4 of 5 ITEM 9. PLANNING & DEVELOPMENT: Ordinance No. 2024-26 Amending Articles 4, 7, 8, 9, 10 & 14 of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances – First Reading No public comment. Administrator Clifford stated that the item was discussed in detail at a prior study session and noted that the changes are minor corrections. It was moved by Councilmember Presnell, seconded by Councilmember Buck, to approve Ordinance No. 2024-26 Amending Articles 4, 7, 8, 9, 10 & 14 of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances – First Reading. Unanimously Approved. (See Attachment #9) ITEM 10. ENGINEERING: Resolution No. 2024-52 Authorizing a Permit for Construction Work No public comment. Administrator Clifford stated that this will authorize the contractor the flexibility for work hours which will assist on the least amount of impact to the citizens on West Avenue through December. It was moved by Councilmember McCauley, seconded by Councilmember McGhee, to approve Resolution No. 2024-52 Authorizing a Permit for Construction Work. Unanimously Approved. (See Attachment #10) ITEM 11. ADMINISTRATIVE REPORTS a. Update on Hurricane Helene Recovery Efforts Administrator Clifford presented an update on the Hurricane Helene Recovery Efforts. (See Attachment #11) Mayor Williams answered questions that were placed on Social Media. In addition, stated that the presentation is being recorded and to be placed on the City’s Facebook Page: City of North Augusta – Public Information. He asked for the residents to follow. ITEM 10. PRESENTATIONS/COMMUNICATIONS/RECOGNITION OF VISITORS: A. Citizen Comments: No public comment B. Council Comments: Mayor Williams recognized Councilmember Presnell for his time on Council, May 2019 to November 2024, and presented him with a plaque. He stated that this is his last City Council meeting as he and his wife will be moving to TN. He thanked him for his leadership and service to the City. Councilmembers individually thanked him and wished him well. Councilmember Presnell thanked everyone and stated that North Augusta will always be his home. the United States and 50,550 will die from the disease; and WHEREAS, pancreatic cancer is one of the deadliest cancers, is currently the third leading cause of cancer death in the United States, and is projected to become the second leading cause around 2030; and WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate at just 12 percent; and WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally in later stages, and 88 percent of pancreatic cancer patients die within the first five years; and WHEREAS, approximately 900 deaths will occur in South Carolina in 2024; and WHEREAS, pancreatic cancer is the seventh most common cause of cancer-related death across the world; and WHEREAS, there were an estimated 495,773 new pancreatic cancer cases diagnosed worldwide in 2020; and WHEREAS, the good health and well-being of the residents of the City of North Augusta are enhanced as a direct result of increased awareness Section 2: General Description In December 2023 a new North Augusta Development Code (NADC) was adopted. It was the intent for much of the text and tables to covert over to the undated code. During this process there were several typing errors, the creation of conflicting text and tables, omitted wording and tables and other miscellaneous errors. The purpose of these text amendments are to correct these errors, omissions, conflicts. Section 3: Planning Commission Consideration The Planning Commission is being asked to review the request for a text amendment based on the following provisions of the North Augusta Development Code: 17.4.1 Authority Under This Article. The Planning Commission (Commission) shall have all the powers and duties as assigned by §6-29-340 of the South Carolina Local Government Comprehensive Planning Enabling Act (Title 6) to be carried out in accordance with these regulations as detailed in Article 17 and in the adopted Rules of Procedure for the Commission. The Director shall transmit the application for zoning amendment or rezoning to the Planning Commission at its next regularly scheduled monthly meeting, provided the complete application is submitted at least 30 calendar days prior to the meeting. The Planning Commission shall approve or deny the zoning amendment in accordance with the procedures for a legislative hearing as provided in the City’s Administrative Manual and the S.C. Code §6-29-760. 1. The Planning Commission shall submit its recommendation to City Council within 30 calendar days after the initial hearing date (S.C. Code §6-29760(A). A majority vote is required for the Planning Commission to approve, approve with conditions (if applicable), or deny a rezoning or text amendment application. 2. The City Council shall consider the recommendation of the Planning Commission and staff on each proposed rezoning and text amendment within 30 days of receipt of the Planning Commission recommendation. The A City Council must consider, but is not bound by, the Planning Commission recommendation in making a final decision and may call for additional information or public hearing(s). 3. Section 18.11 does not require additional standards for analysis to address in this staff report. Section 4: Public notice A public notice of the text amendment request and scheduled date of the Planning Commission public hearing was published in the Augusta Chronicle and on the City’s website www.northaugustasc.gov on September 29, 2024. Section 5: History The North Augusta Development Code that was adopted by City Council December 17, 2007, effective January 1, 2008 was repealed and replaced by the North Augusta Development Code adopted by City Council on December 18, 2023. The 2023 Development Code is consistent with the Comprehensive Plan Update of 2022. Public comments were solicited through formal public hearing and informal communication throughout the multiyear development of the code The North Augusta Planning Commission recommended approval of a draft Development Code and referred to City council on June 6, 2023. City Council, in accordance with Section 6-29-760 of the South Carolina Code of Laws held a public hearing on September 11, 2023. Based on information from the public hearing the Development Code draft was referred back to the Planning Commission for further recommendations. At the October 18, 2023 Planning Commission meeting the Commission heard public input and reviewed issues that were heard in Council’s public hearing. At the November 15, 2023 meeting of the Planning Commission, the Commission recommended a revised draft for adoption by City Council. City Council adopted this draft at their December 18, 2023 meeting. Section 6: Summary of Changes and Proposed Amendments The Planning Director requested that the Planning Commission review several issues at a study session on September 18, 2024. As a result of that study session the Planning Commission indicated that they would like to see several changes to correct typing errors, the creation of conflicting text and tables, omitted wording and tables and other miscellaneous errors. Specific days and times for work will be determined by the contractor, with at least 24 hours notice provided to the City of North Augusta. • Scope of Exemption: This exemption applies exclusively to noise generated by construction activities and equipment directly related to the West Avenue Crosswalk Project and does not permit excessive or unnecessary noise unrelated to the project. • Safety and Traffic Control: Palmetto Construction Management will provide all necessary safety and traffic control measures to ensure the protection of workers and the public during late evening operations. • Public Notification: The City will coordinate with the contractor to notify citizens of planned late evening work, providing sufficient notice to minimize inconvenience to residents in the affected area. The City of North Augusta reserves the right to extend, modify, or terminate this permit as deemed necessary.
