Toole, Councilmember ORDER OF BUSINESS REGULAR MEETING The Regular meeting of the City Council of the City of North Augusta of December 18, 2023 having been duly publicized was called to order by Mayor Williams at 6:00pm and also streamed online for public viewing at “City of North Augusta – Public Information” on www.Facebook.com and on the “City of North Augusta Public Information” on www.YouTube.com. Per Section 30-4-80, (e) notice of the meeting by email was sent out to the current maintained “Agenda Mailout” list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Williams read the Christmas Story from Luke 2:1-21 and rendered the Pledge of Allegiance. Mayor Williams rendered the invocation and the Pledge of Allegiance. Members present were Mayor Williams, Councilmembers Buck, Carpenter, McCauley, McGhee, Presnell, and Toole. Also, in attendance were Representative Bill Hixon, Senator Tom Young Jr., Aiken County School Board Member (District 4) Dr. Patricia Hanks, James S. Clifford, City Administrator; Kelly F. Zier, City Attorney; John C. Thomas, Director of Public Safety; Ricky Jones, Manager of Information Technology; and Jamie Paul, City Clerk. Page 2 of 6 ITEM 4. APPROVAL OF MINUTES: The minutes of the City Council Meeting of December 4, 2023 and Study Session of December 11, 2023, were approved as submitted by general consent. ITEM 5. COMMUNITY PROMOTION: Recognition of the Winners of the 2023 Mayor’s Writing Contest Mayor Williams thanked all of the 332 participants that submitted the 2023 Mayor’s Coloring Contest and read the names of the winners. (See Attachment #5a) Mayor Williams recognized the winners of the 2023 Mayor’s Writing Contest. (See Attachment #5): ITEM 6. PERSONNEL: Chief John Thomas, Retirement – Recognition of Service to the City of North Augusta Mayor and Councilmembers provided words of appreciation to Chief John Thomas and congratulated him on his retirement. Representative Bill Hixon presented Chief Thomas with the South Carolina State Flag that was flown over the state house in Columbia, SC and thanked him for his service to the City of North Augusta and their years of friendship. Senator Tom Young, Jr., presented Chief Thomas with the Unites States Flag that was flown over the state house in Columbia, SC and thanked him for all of his years in law enforcement. Mayor Williams recognized Chief John C. Thomas began his career in law enforcement 42 years ago in 1981. He is a graduate from Limestone College where he received his Bachelor of Science degree. In 1999 he graduated from the FBI National Academy, in Quantico, VA. Currently, he is the Director of Public Safety in North Augusta. He has held positions in Clinton, SC as the Director of Public Safety. He was the Training Program Manager for the South Carolina Department of Public Safety in Columbia, SC. He was also a Consultant and Instructor for the Public Agency Training Council in Indianapolis, IN. Mayor Williams added that Chief Thomas is a member of the SC Criminal Justice Training Council, the FBI- National Academy Association, SC Law Enforcement Officers Association, SC Police Chief’s Association and the SC State Fire Fighters Association. He and his wife Caroline are members of First Baptist Church of North Augusta. They have 5 grandchildren, one son, Adam and one daughter, Jessica. Chief Thomas introduced his wife, Caroline, and thanked her for her support from day one and over the 30 years. He thanked his Public Safety employees and stated they are top notch and that he has enjoyed working/living in North Augusta. Page 3 of 6 OLD BUSINESS ITEM 7. PLANNING & DEVELOPMENT: Ordinance No. 2023-32 Adopting the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances, Providing for New Zoning and Land Development Regulations and Updating the City-Wide Zoning Map Accordingly – Second Reading Administrator Clifford stated that there are no further updates on this item and that staff recommends approval on the second reading. Public Comment: Daniel Geddes, resident, commented that he is concerned about property rights such as larger setbacks on the wetlands and not to have the government have total control over the citizens. It was moved by Councilmember McCauley, seconded by Councilmember McGhee, to approve Ordinance No. 2023-32 Adopting the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances, Providing for New Zoning and Land Development Regulations and Updating the City-Wide Zoning Map Accordingly – Second Reading. Unanimously Approved. (See Attachment #7) ITEM 8. PLANNING & DEVELOPMENT: Ordinance No. 2023-33 to Amend the Zoning Map of the City of North Augusta, South Carolina by Rezoning ±.29 Acres of Land Owned by Charlie Britt, Aiken County Tax Parcel No. 006-18-10-003 from R-7, Small Lot, Single-Family Residential to R-5 Mixed Residential – Second Reading No public comment. It was moved by Councilmember Presnell, seconded by Councilmember McCauley, to approve Ordinance No. 2023-33 to Amend the Zoning Map of the City of North Augusta, South Carolina by Rezoning ±.29 Acres of Land Owned by Charlie Britt, Aiken County Tax Parcel No. 006-18-10-003 from R-7, Small Lot, Single-Family Residential to R-5 Mixed Residential – First Reading. Unanimously Approved. (See Attachment #8) NEW BUSINESS ITEM 9. ADMINISTRATION: Resolution No. 2023-50 Authorizing Expenditure of Coronavirus State and Local Fiscal Recovery Funds – Expenditure Request 10 No public comment. Administrator Clifford stated that he would like to request a special called Council meeting over the next three weeks as the R.D. Brown pricing came in earlier for the Amphitheater project and is not ready as there would be cost savings and the numbers need to be finalized. He noted the ARPA request is scaled down to two items, one for the development of the Capital Improvement program and impact fee, and the Chillers. It was moved by Councilmember Buck, seconded by Councilmember Carpenter, to approve Resolution No. 2023-50 Authorizing Expenditure of Coronavirus State and Local Fiscal Recovery Funds – Expenditure Request 10. Unanimously Approved. (See Attachment #9) Page 4 of 6 ITEM 10. PLANNING AND DEVELOPMENT: Resolution No. 2023-51 Authorizing the City of North Augusta to Enter into a Professional Engineering Services Contract with TischlerBise, Inc. to Perform Services for Creation of an Impact Fee Structure and Capital Improvement Plan No public comment. Administrator Clifford stated that this was an RFP process and three firms responded. He highlighted on the project process starting in January with anticipation of completion potentially in late July. It was moved by Councilmember McCauley, seconded by Councilmember Presnell, to approve Resolution No. 2023-51 Authorizing the City of North Augusta to Enter into a Professional Engineering Services Contract with TischlerBise, Inc. to Perform Services for Creation of an Impact Fee Structure and Capital Improvement Plan. Unanimously Approved. (See Attachment #10) ITEM 11. PARKS AND RECREATION: Resolution No. 2023-52 Authorizing the City of North Augusta to Enter into a Professional Engineering Services Contract with McCarter Mechanical, Inc. to Perform Replacement Services of the Chiller at the Riverview Park Activity Center No public comment. Administrator Clifford stated the current chiller is not economically feasible and request approval on the lowest bid presented. It was moved by Councilmember Buck, seconded by Councilmember Carpenter, to approve Resolution No. 2023-52 Authorizing the City of North Augusta to Enter into a Professional Engineering Services Contract with McCarter Mechanical, Inc. to Perform Replacement Services of the Chiller at the Riverview Park Activity Center. Unanimously Approved. (See Attachment #11) ITEM 12. ADMINISTRATION: Resolution No. 2023-53 Authorizing the City of North Augusta to Enter into a Professional Services Contract with Placer Labs, Inc., to Perform Services for the Delivery of Data Analytics in Support of Economic Development and Tourism No public comment. Administrator Clifford stated that a number of cities have used Placer AI as a way to get data on who’s in your City, how did they get there, where did they go from here. He added that this company would be able to provide accurate foot traffic counts and gave Third Thursday as an example. He clarified this would be a tool for economic development and tourism. It was moved by Councilmember McCauley, seconded by Councilmember Toole, to approve Resolution No. 2023-53 Authorizing the City of North Augusta to Enter into a Professional Services Contract with Placer Labs, Inc., to Perform Services for the Delivery of Data Analytics in Support of Economic Development and Tourism. ENGINEERING: Resolution No. 2023-54 Authorizing the City of North Augusta to Enter into a Contract with Steed Paving to Perform Pavement Repair and Resurfacing No public comment. Administrator Clifford stated that they received two bids. It was moved by Councilmember Presnell, seconded by Councilmember Buck, to approve Resolution No. 2023-54 Authorizing the City of North Augusta to Enter into a Contract with Steed Paving to Perform Pavement Repair and Resurfacing. Unanimously Approved. (See Attachment #13) ITEM 14. BOARDS AND COMMISSIONS: Appointment to the North Augusta Beautification Foundation – Recommendation by Mayor No public comment. Mayor Williams provided a brief overview of Billy Frankie’s qualifications. Mayor Williams recommended the Appointment of Billy Frankie to the North Augusta Beautification Foundation. It was moved by Councilmember Carpenter, seconded by Councilmember Buck, to approve the Mayor’s recommendation of the attached appointment. Unanimously Approved. (See Attachment #14) ITEM 15. CITY COUNCIL: City of North Augusta City Council Meeting Schedule and Notice for January 2024 through December 2024 No public comment. It was moved by Councilmember Presnell, seconded by Councilmember Carpenter, to approve the City of North Augusta City Council Meeting Schedule and Notice for January 2024 through December 2024. ADMINISTRATIVE REPORTS Administrator Clifford thanked Chief Thomas for letting him see the Public Safety Department as a whole and stated that his leadership will be missed. ITEM 17. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: ORDINANCE ADOPTING THE NORTH AUGUSTA’S DEVELOPMENT CODE I. Upon adoption of this ordinance on second and final reading, the previous Development Code, Ordinance #2007-22, adopted December 17, 2007, along with all amendments thereto, is repealed in its entirety. III. All other Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. IV. The North Augusta Development Code will be effective upon adoption. V. All development applications deemed complete and received by the city prior to adoption of the North Augusta Development Code will be processed under the 2007 North Augusta Development Code. VI. If the Planning Director determines that a project was significantly under design but not yet submitted the Planning Director may, in his discretion, may allow the project to be developed under the previous code. VII. The attached city-wide Zoning Map for the City of North Augusta, South Carolina is hereby adopted for the purposes of applying new zoning district names and designations and does not change the underlying zoning district classifications. VIII. Upon adoption of the 2023 North Augusta Development Code the previous Zoning Map, adopted December 17, 2007 by Ordinance 2007-22, along with all amendments thereto, is repealed in its entirety. Development Code and a citywide Zoning Map which is consistent with the City’s North Augusta 2017 Comprehensive Plan; and WHEREAS, the property owner, Charlie Britt, has requested the property be Those firms were David Taussig & Associates, Kimley Horne, and TischlerBise. The proposals were scored by Tom Zeaser, Director of Engineering & Public Works, James Sutton, Director of Public Services, Kuleigh Baker, Planner, and myself. The overall possible score was 320 points and the table below provide the results for each firm: Based on this scoring, staff is recommending TischlerBise for the contract at a cost of $97,340 In calls to former/current clients I received only positive comments and all said that they would hire them again. Carson Bise, the proposed project manager, has experience in 14 other projects in the state of South Carolina where his firm developed both the CIP and impact fee ordinance. In comparison, the project manager for each of the other proposals had one similar type project in the state. TischlerBise, with Carson Bise as the project manager, also did the CIP and impact fee for Fort Mill School District. In Homebuilders Association of South Carolina v. York County, the validity of the state statue was challenged and decided in favor of York County by the SC Supreme Court. According to the Assistant Superintendent of Finance and Operations for the school district, Mr. Bise was heavily involved in assisting the county throughout the litigation. TischlerBise also did a CIP/impact fee for the Town of Summerville. This fee was also appealed to the South Carolina Supreme Court in Charleston Trident Home Builders v. Town Council of Town of Summerville. Again, the Court upheld the ordinance and fee stating, “We conclude on the merits that Town’s ordinance substantially complies with the statutory requirements set forth in the Act regarding the capital improvements plan and that the calculation of fees is proper.” Carson Bise was also selected to be a presenter at the MASC Community Development Association’s Fall meeting in 2022 where he provided educational information on impact fees.
