ORDINANCE NO. 2023-32
ADOPTING THE NORTH AUGUSTA DEVELOPMENT CODE,
CHAPTER 18 OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA
CODE OF ORDINANCES, PROVIDING FOR NEW ZONING AND LAND DEVELOPMENT
REGULATIONS AND UPDATINGTHE CITY-WIDE ZONING MAP ACCORDINGLY
WHEREAS, pursuant to Title 6, Chapters 29 and 31 of the South Carolina Code, the
North Augusta Planning Commission has the responsibility to prepare zoning and land
development regulations for adoption by the North Augusta City Council; and
WHEREAS, such zoning and land development regulations have been revised and
updated approximately every ten (10) years; and
WHEREAS; the most recently revised regulations were adopted in 2007 as the North
Augusta Development Code; and
WHEREAS, the North Augusta Planning Commission has spent several years in the
preparation of a Development Code which is consistent with the city's 2022 Comprehensive
Plan; and
WHEREAS, the proposed Development Code incorporates all city zoning and land
development
regulations; and
WHEREAS, the proposed Development Code will replace the 2007 North Augusta
Development Code; and
WHEREAS, public comment was solicited through formal public hearings and informal
communication throughout the multiyear document preparation process; and
WHEREAS, the 2023 North Augusta Development Code is consistent with the city's
2022 Comprehensive Plan; and
WHEREAS, the North Augusta Planning Commission approved the draft North Augusta
Development Code on June 6, 2023 and recommended it to the City Council for approval; and
WHEREAS, City Council held a public hearing on September 11, 2023 in accordance
with Section 6-29-760 of the South Carolina Code of Laws; and
WHEREAS, an updated zoning map for the purposes of aligning existing zoning districts
with new zoning district names and designations has been prepared which does not change the
underlying zoning district classifications.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY
ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
ORDINANCE ADOPTING THE NORTH AUGUSTA’S DEVELOPMENT CODE
I. That the proposed North Augusta Development Code dated November 20, 2023 as submitted
by the Planning Commission. The North Augusta Development Code, Chapter 18 of The City of
North Augusta, South Carolina Code of Ordinances, Providing for New Zoning and Land

shall read as follows:

II. Upon adoption of this ordinance on second and final reading, the previous Development
Code, Ordinance #2007-22, adopted December 17, 2007, along with all amendments thereto, is
repealed in its entirety.
III. All other Ordinances or parts of Ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
IV. The North Augusta Development Code will be effective upon adoption.
V. All development applications deemed complete and received by the city prior to adoption of
the North Augusta Development Code will be processed under the 2007 North Augusta
Development Code.
VI. If the Planning Director determines that a project was significantly under design but not yet
submitted the Planning Director may, in his discretion, may allow the project to be developed
under the previous code.
VII. The attached city-wide Zoning Map for the City of North Augusta, South Carolina is hereby
adopted for the purposes of applying new zoning district names and designations and does not
change the underlying zoning district classifications.
VIII. Upon adoption of the 2023 North Augusta Development Code the previous Zoning Map,
adopted December 17, 2007 by Ordinance 2007-22, along with all amendments thereto, is
repealed in its entirety.
DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS _________ DAY OF
DECEMBER, 2023.

ORDINANCE NO. 2023-33
TO AMEND THE ZONING MAP OF THE CITY OF NORTH AUGUSTA,
SOUTH CAROLINA BY REZONING ±.29 ACRES OF LAND
OWNED BY CHARLIE BRITT, AIKEN COUNTY TAX PARCEL NO. 006-18-10-003
FROM R-7, SMALL LOT, SINGLE-FAMILY RESIDENTIAL
TO R-5 MIXED RESIDENTIAL
WHEREAS, on December 17, 2007, by Ordinance 2007-22, the North Augusta City Council
adopted the North Augusta Development Code and a citywide Zoning Map which is consistent with the
City’s North Augusta 2017 Comprehensive Plan; and
WHEREAS, the property owner, Charlie Britt, has requested the property be rezoned from R-7,
Small Lot, Single-Family Residential to R-5, Mixed Residential; and
WHEREAS, the North Augusta Planning Commission, following a November 15, 2023 public
hearing, reviewed and considered a request by Charlie Britt to amend the Official Zoning Map of North
Augusta from R-7, Small Lot, Single-Family Residential to R-5, Mixed Residential for an approximately
±.29 acre consisting of tax parcel 006-18-10-003 and has issued their recommendation. The staff reports
and the recommendation of the Planning Commission have been provided to City Council.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY
THE AUTHORITY THEREOF, THAT:
I. A parcel consisting of +.29 acres owned by Charlie Britt, is hereby rezoned from R-7, Small
Lot, Single-Family Residential to R-5, Mixed Residential. Said property is Aiken County tax
map parcel 006-18-10-003 and specifically identified as Exhibit “B” attached hereto.
II The Official Zoning Map for the City of North Augusta is hereby amended to reflect
this rezoning.
III. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict,
hereby repealed.
IV. This Ordinance shall become effective immediately upon its adoption on second and final
reading.

A RESOLUTION AUTHORIZING EXPENDITURE OF CORONAVIRUS STATE AND LOCAL
FISCAL RECOVERY FUNDS – EXPENDITURE REQUEST 10
WHEREAS, on July 19, 2021, City Council adopted Resolution 2021-30 authorizing receipt of the
Coronavirus State and Local Fiscal Recovery Fund (SLFRF) allocation totaling $11,871,089.22 from the
State of South Carolina as appropriated by the American Rescue Plan Act of 2021; and
WHEREAS, City Council adopted Resolution 2022-12, which obligated SLFRF funds for use
between revenue loss replacement and investment in water and sewer infrastructure; and
WHEREAS, City Council adopted Resolution 2022-13, which authorized Expenditure Request 1
totaling $3,965,004 for two projects; and
WHEREAS, City Council adopted Resolution 2022-28, which authorized Expenditure Request 2
totaling $3,123,632 for one project; and
WHEREAS, City Council adopted Resolution 2022-35, which authorized Expenditure Request 3
totaling $1,367,000 for six projects; and
WHEREAS, City Council adopted Resolution 2022-53, which authorized Expenditure Request 4
totaling $1,600,000 for several projects; and
WHEREAS, City Council adopted Resolution 2023-17, which authorized Expenditure Request 5
totaling $89,800 for one project; and
WHEREAS, City Council adopted Resolution 2023-25, which authorized Expenditure Request 6
totaling $450,000 for a replacement tanker truck and equipment; and
WHEREAS, City Council adopted Resolution 2023-29, which authorized the release of
encumbered funds to be placed as unencumbered in the SLFRF funds totaling $2,063,915; and
WHEREAS, City Council adopted Resolution 2023-30, which authorized Expenditure Request 7
totaling $50,000 for Greeneway improvements; and
WHEREAS, City Council adopted Resolution 2023-40, which authorized Expenditure Request 8
totaling $770,000 for Financial Software; and
WHEREAS, City Council adopted Resolution 2023-45, which authorized the release of
encumbered funds to be placed as unencumbered in the SLFRF funds totaling $4,357; and
WHEREAS, City Council adopted Resolution 2023-46, which authorized Expenditure Request 9
totaling $600,000 for boat dock and overlook portions of the Sharon Jones Amphitheater improvements;
and
WHEREAS, expenditure of SLFRF funds are required to be approved by City Council via
resolution; and
WHEREAS, new projects have been identified and recommended for expenditure totaling
$395,611 as outlined in Appendix A; and
WHEREAS, with this expenditure, $1,528,314 remains of available SLFRF funds for future
expenditures.

Augusta, South Carolina, in a meeting duly assembled and by the authority thereof, that:
1. Expenditures of $395,611 of SLFRF funds is approved for the projects listed in Appendix A.
2. The City will follow its adopted procurement ordinance as it relates to SLFRF funds.
3. The City Administrator is authorized to execute such documents as necessary to enter into
agreements and implement the projects as outlines in Appendix A.
4. Any monies not spent on the any projects listed in Appendix A will be made available in SLRF
funds for future expenditures.

TO ENTER INTO A PROFESSIONAL ENGINEERING SERVICES CONTRACT
WITH TISCHLERBISE, INC. TO PERFORM SERVICES FOR CREATION
OF AN IMPACT FEE STRUCTURE AND CAPITAL IMPROVEMENT PLAN
WHEREAS, the City of North Augusta desires to retain the services of TischlerBise, Inc.
to provide services related to the evaluation and design of an Impact Fee and Capital Improvement
Plan; and
WHEREAS, three (3) firms responded to a “Request for Proposals” and were reviewed by
a committee consisting of the Director of Planning and Development, Director of Engineering and
Public Works, Director of Public Services, and a Planner for the City of North Augusta; and
WHEREAS, based upon the ranking of the firms, it has been determined that TischlerBise,
Inc. was the preferred contractor; and
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
North Augusta, South Carolina, in meeting duly assembled and by the authority thereof that the
City is authorized to enter into professional engineering services contract with TischlerBise, Inc.
to provide services to create an Impact Fee structure and a Capital Improvement Plan.
BE IT FURTHER RESOLVED that the City Administrator is authorized to execute such
documents as necessary to enter into said contracts for an amount not to exceed $97,340.

Re: Recommendation for Consultant Services Impact Fee/CIP
Date: December 12, 2023
The city received three responses to the request for proposals for consultant services to develop a
capital improvement program (CIP) and an impact fee. Those firms were David Taussig &
Associates, Kimley Horne, and TischlerBise. The proposals were scored by Tom Zeaser,
Director of Engineering & Public Works, James Sutton, Director of Public Services, Kuleigh
Baker, Planner, and myself. The overall possible score was 320 points and the table below
provide the results for each firm:
Based on this scoring, staff is recommending TischlerBise for the contract at a cost of $97,340
In calls to former/current clients I received only positive comments and all said that they would
hire them again.
Carson Bise, the proposed project manager, has experience in 14 other projects in the state of
South Carolina where his firm developed both the CIP and impact fee ordinance. In comparison,
the project manager for each of the other proposals had one similar type project in the state.
TischlerBise, with Carson Bise as the project manager, also did the CIP and impact fee for Fort
Mill School District. In Homebuilders Association of South Carolina v. York County, the validity
of the state statue was challenged and decided in favor of York County by the SC Supreme
Court. According to the Assistant Superintendent of Finance and Operations for the school
district, Mr. Bise was heavily involved in assisting the county throughout the litigation.
TischlerBise also did a CIP/impact fee for the Town of Summerville. This fee was also appealed
to the South Carolina Supreme Court in Charleston Trident Home Builders v. Town Council of
Town of Summerville. Again, the Court upheld the ordinance and fee stating, “We conclude on
the merits that Town’s ordinance substantially complies with the statutory requirements set forth
in the Act regarding the capital improvements plan and that the calculation of fees is proper.”
Carson Bise was also selected to be a presenter at the MASC Community Development
Association’s Fall meeting in 2022 where he provided educational information on impact fees.

WHEREAS, City Council has approved funding for the replacement chiller as part of
Coronavirus State and Local Fiscal Recovery Funds – Expenditure Request 10, Resolution 2023-
50; and
WHEREAS, the City of North Augusta desires to retain the services of an outside
contractor to replace the chiller unit at the Riverview Park Activities Center; and
WHEREAS, four (4) firms responded to a sealed bid “Request for Proposals”; and
WHEREAS, McCarter Mechanical, Inc. out of Spartanburg, SC was the low bidder at
$298,271; and
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the
City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof
that the City is authorized to enter into professional engineering services contract with McCarter
Mechanical, Inc. to replace the chiller unit at the Riverview Park Activities Center.
BE IT FURTHER RESOLVED that the City Administrator is authorized to execute
such documents as necessary to enter into said contracts for an amount not to exceed $298,271.

AUTHORIZING THE CITY OF NORTH AUGUSTA
TO ENTER INTO A PROFESSIONAL SERVICES CONTRACT
WITH PLACER LABS, INC. TO PERFORM SERVICES FOR THE DELIVERY OF DATA
ANALYTICS IN SUPPORT OF ECONOMIC DEVELOPMENT AND TOURISM
WHEREAS, on November 7, 2022, City Council adopted a balanced budget for the fiscal
year beginning on January 1, 2023, and ending on December 31, 2023 which included funding
within the General Fund for economic development; and
WHEREAS, the City Administrator has recommended an agreement with Placer Labs,
Inc., a data aggregation company that provides data to a number of municipalities in the State of
South Carolina; and
WHEREAS, City Council believes it to be in the best interest of the City to finalize an
agreement with Placer Labs, Inc. for data which would support economic development and tourism
initiatives for the City; and
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of

City is authorized to enter into professional engineering services contract with Placer Labs, Inc.
not to exceed $16,000 to be charged to the economic development line of the 2023 General Fund
Budget.
BE IT FURTHER RESOLVED that the City Administrator is authorized to execute such
documents as necessary to enter into said contracts for an amount not to exceed $16,000.

AUTHORIZING THE CITY OF NORTH AUGUSTA TO ENTER INTO A CONTRACT
WITH STEED PAVING TO PERFORM PAVEMENT REPAIR AND RESURFACING
WHEREAS, on November 20, 2023, in accordance with City’s purchasing
ordinance, a Request for Proposals (RFP) was posted on the City’s website seeking bids
for performing asphalt repair and resurfacing of various City streets, as well as a portion of
Clay Pit Road and the Operations Facility, which provide access and support of the
proposed Solid Waste Transfer Station; and
WHEREAS, on December 14, 2023, sealed bids were received, publicly opened
and read aloud; and
WHEREAS, the low bid by Steed Paving is in the amount of $362,591.80.
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the
City of North Augusta, South Carolina, in a meeting duly assembled and by the authority
thereof, that Steed Paving shall be awarded the contract for the 2024 Pavement Repair and
Resurfacing Project at the bid amount of $362,591.80.
BE IT FURTHER RESOLVED that the funding sources for this contract shall be
as follows:
2024 Budget Acct #10-4220-226 $101,827.00
Acct #36-4241-387 $260,764.80
Total $362,591.80
BE IT FURTHER RESOLVED that the City Administrator is authorized to execute
such documents as necessary to enter into this contract.

Pursuant to the South Carolina Code of Laws §30-4-80(a), notice is hereby given to the members of the North Augusta City
Council and to the general public that the North Augusta City Council will hold meetings open to the public on the following
dates and times. A copy of the agenda for each meeting will be available at least 24 hours in advance in the City Clerk’s Office,
at 100 Georgia Avenue, North Augusta, South Carolina. A notice of each meeting will be sent by email to the current maintained
“Agenda Mail Out” list consisting of news media outlets and individuals or companies requesting notification. Notice of the
meetings will also be posted by the outside doors of the Municipal Center, on the main bulletin board located on the first floor of
