Toole, Councilmember ORDER OF BUSINESS The Public Hearing was streamed for public viewing online at: “City of North Augusta – Public Information” on www.Facebook.com and “City of North Augusta Public Information” on www.YouTube.com. PUBLIC HEARING Proposed Consolidated Annual Budget for Fiscal Year 2024 The Public Hearing for the Proposed Consolidated Annual Budget for Fiscal Year 2024 began at 5:30pm. Members present were Mayor Williams, Councilmembers Buck, Carpenter, McCauley, McGhee, Presnell, and Toole. Also in attendance were James S. Clifford, City Administrator; Kelly F. Zier, City Attorney; Lynda Williamson, Director of Finance; Ricky Jones, Manager of Information Technology, and Jamie Paul, City Clerk. Comments were made by the following citizen: • Kenton Makin, regarding Public Safety allocation. Discussion from Council ensued on potential military active duty discounts for the Parks and Recreation Activity Center. The Public Hearing concluded at 5:38pm. Page 2 of 7 REGULAR MEETING The Regular meeting of the City Council of the City of North Augusta of October 16, 2023 having been duly publicized was called to order by Mayor Williams at 6:00pm and also streamed online for public viewing at “City of North Augusta – Public Information” on www.Facebook.com and on the “City of North Augusta Public Information” on www.YouTube.com. Per Section 30-4-80, (e) notice of the meeting by email was sent out to the current maintained “Agenda Mailout” list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Williams rendered the invocation and the Pledge of Allegiance. Members present were Mayor Williams, Councilmembers Buck, Carpenter, McCauley, McGhee, Presnell, and Toole. Also, in attendance were James S. Clifford, City Administrator; Kelly F. Zier, City Attorney; Lynda Williamson, Director of Finance; John C. Thomas, Director of Public Safety; Ricky Jones, Manager of Information Technology; and Jamie Paul, City Clerk. ITEM 4. APPROVAL OF MINUTES: The minutes of the City Council Meeting of October 2, 2023 and Study Session of October 9, 2023, were approved as submitted by general consent. OLD BUSINESS ITEM 5. PLANNING AND DEVELOPMENT: Ordinance No. 2023-16 to Amend the Zoning Map of the City of North Augusta, South Carolina by Rezoning ± 9.84 Acres of Land Owned by CSRA Development Company, Aiken County Tax Parcel No. 007-15-03-002 from R-10, Medium Lot, Single-Family Residential to R-7, Small Lot, Single-Family Residential – Second Reading No public comment. Hewitt, Isabella Mackie, Terence A. Mackie, & Anna Margaret Edwards – Second Reading No public comment. Page 3 of 7 It was moved by Councilmember Buck, seconded by Councilmember Presnell, to approve Ordinance No. 2023-17 to Change the Corporate Limits of the City of North Augusta by Accepting the Petition Requesting Annexation by the Landowners and Annexing ±27.48 Acres of Property Located at 244 & 246 Clearmont Drive and Owned by Pearle E. Hewitt, Isabella Mackie, Terence A. Mackie, & Anna Margaret Edwards – Second Reading. Unanimously Approved. (See Attachment #6) ITEM 7. ADMINISTRATION: Ordinance No. 2023-18 to Amend the Code of Laws for the City of North Augusta. Specifically, Section 2-101, Qualifications for City Administrator. – Second Reading Public Comments: Fred Ilardi, resident, commented that he does not agree that the change of the qualifications for the Administrator position that was required at the time of hire should change, specifically the residency requirement for the Administrator. He stated the opinion that the ordinance has been satisfactory for over 50 years and does not need to change and that the Administrator should comply. He requested that the Administrator answer the question why he is not complying. Councilmember Carpenter asked the question of potentially adding in wording in for a radius outside of the City for the Administrator to live within. Attorney Zier explained that the Ordinance presented is the same wording that the majority of the other municipalities use, however, the Council can change if they choose to. He clarified that the Ordinance provides Council the ability to do whatever they feel is best for the position and prior to it did not. Discussion ensued with Council regarding the amendment of the Code of Laws for the City of North Augusta and the requirement of residency with the City or not. Administrator Clifford stated that as a longtime military person retiree and now as the City Administrator that he believes in the American democracy and is grateful to serve as the City Administrator. He added that he is proud to be an American citizen and that the Constitution protects the public to say what they would like to say. It was moved by Councilmember McCauley, seconded by Councilmember Carpenter, to approve Ordinance No. 2023-18 to Amend the Code of Laws for the City of North Augusta. Specifically, Section 2- 101, Qualifications for City Administrator. – First Reading. Vote: 6 – 1 with Nay from Councilmember Toole. Approved. (See Attachment #7) NEW BUSINESS ITEM 8. FINANCE: Ordinance No. 2023-19 Adopting a Budget for Fiscal Year 2024 Containing Estimates of Proposed Revenues and Expenditures by the City of North Augusta, South Carolina, for the Budget Year Beginning January 1, 2024, and Declaring that Same Shall Constitute the Budget of the City of North Augusta for Such Budget Year – First Reading No public comment. Page 4 of 7 Mayor Williams explained that Items 8 through 13 all relate to the Fiscal Year (FY) 2024 Budget and asked if Council has any questions on any of Ordinances to discuss all together versus at each item. Administrator Clifford stated that Items 8 and 9 are the approval of budget document and then the annual tax levy for the general fund. He noted that items 10-12 are subsequent ordinances which include rate changes for stormwater, wastewater, and water rate schedule. He pointed out item 12 is for business licenses and is derived from the State. He commented that there is a 2Mil recommended increase under the general fund. He clarified the majority of the increase is for the increase for the competitive wages for Public Safety Officers, additional staff which was discussed at the Greenwood offsite retreat as well as other minor costs associated with transportation. He added that staff is presenting a balance budget for FY 2024 for council consideration. It was moved by Councilmember Carpenter, seconded by Councilmember Buck, to approve Ordinance No. 2023-19 Adopting a Budget for Fiscal Year 2024 Containing Estimates of Proposed Revenues and Expenditures by the City of North Augusta, South Carolina, for the Budget Year Beginning January 1, 2024, and Declaring that Same Shall Constitute the Budget of the City of North Augusta for Such Budget Year – First Reading. Unanimously Approved. (See Attachment #8) ITEM 9. FINANCE: Ordinance No. 2023-20 Levying the Annual Tax on Property in the City of North Augusta, South Carolina, for the Fiscal Year Beginning January 1, 2024, and Ending December 31, 2024 – First Reading No public comment. It was moved by Councilmember McGhee, seconded by Councilmember Carpenter, to approve Ordinance No. 2023-20 Levying the Annual Tax on Property in the City of North Augusta, South Carolina, for the Fiscal Year Beginning January 1, 2024, and Ending December 31, 2024 – First Reading. FINANCE: Ordinance No. 2023-24 Amending the Business License Ordinance of the City of North Augusta to Update the Class Schedule as Required by Act 176 of 2020 – First Reading No public comment. It was moved by Councilmember McCauley, seconded by Councilmember McGhee, to approve Ordinance No. 2023-24 Amending the Business License Ordinance of the City of North Augusta to Update the Class Schedule as Required by Act 176 of 2020 – First Reading. ADMINISTRATION: Ordinance No. 2023-25 Authorizing the Sale of Surplus City Property at 1711 Plank Road, Parcel 006-15-06-017 – First Reading No public comment. Administrator Clifford reviewed the history of the property to Council and stated that staff recommends approval. Administrator Clifford explained the process of how the land would be sold with the guidance from the City of Attorney. It was moved by Councilmember Presnell, seconded by Councilmember McGhee, to approve Ordinance No. 2023-25 Authorizing the Sale of Surplus City Property at 1711 Plank Road, Parcel 006-15-06-017 – First Reading. Unanimously Approved. (See Attachment #14) ITEM 15. PLANNING & DEVELOPMENT: Resolution No. 2023-39 Directing the City of North Augusta Planning Commission to Conduct Studies and to Recommend an Impact Fee Ordinance Pursuant to S.C. Code §6-1-950 No public comment. Page 6 of 7 Administrator Clifford noted that the resolution is the result from the guidance from Council at the last study session where Planning and Development Director presented on the process. It was moved by Councilmember Toole, seconded by Councilmember McCauley, to approve Resolution No. 2023-39 Directing the City of North Augusta Planning Commission to Conduct Studies and to Recommend an Impact Fee Ordinance Pursuant to S.C. Code §6-1-950. Unanimously Approved. (See Attachment #15) ITEM 16. ADMINISTRATION: Resolution No. 2023-40 Authorizing Expenditure of Coronavirus State and Local Fiscal Recovery Funds – Expenditure Request 8 No public comment. Administrator Clifford stated that items 16 & 17 are linked. Item 16 is the approval to allocate funds from the ARPA fund to use for the upgraded Financial Software and item 17 is the authorization to enter into the contract with the software vendor GovSense. Discussion ensued relative to the software and additional modules that could be added or pursue other software for other departments specific to their needs, however, in the future. It was moved by Councilmember Presnell, seconded by Councilmember Buck, to approve Resolution No. 2023-40 Authorizing Expenditure of Coronavirus State and Local Fiscal Recovery Funds – Expenditure Request 8. FINANCE: Resolution No. 2023-41 Authorizing the City of North Augusta to Enter into a Professional Services Contract for Enterprise Resource Planning Software Services No public comment. SPECIFICALLY, SECTION 2-101, QUALIFICATIONS FOR CITY ADMINISTRATOR. WHEREAS, the Mayor and City Council have reviewed the existing Section 2-101 of the City Code establishing qualifications for the Office of City Administrator; and, WHEREAS, the review by Council has included reviews of Ordinances throughout the State by cities employing either a City Administrator or City Manager; and, WHEREAS, the current Code requires that the City Administrator, during his tenure of office shall reside within the City; and, WHEREAS, Mayor and Council have determined that such policy is extremely restrictive and could prevent the City from employing and retaining the most qualified person to hold such office and represent the City; and WHEREAS, the Council has determined that the vast majority of cities within the State have no specific requirement requiring residency within the City although some while not requiring such residency have a provision that would allow the City Administrator to reside outside of the City with the approval of Council; and WHEREAS, the Mayor and City Council have determined that it is in the best interest of the City to amend the City Ordinance at this time. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council for the City of North Augusta, South Carolina in meeting duly assembled and by the authority thereof that: Section 2-101 - Qualifications be deleted in its entirety as currently written and replaced by the following: SECTION 2-101 – QUALIFICATIONS: (a) The Council shall employ an administrator and fix his/her compensation. The administrator shall be employed solely on the basis of his executive and administrative qualifications. He/she need not be a resident of the city or state at the time of his employment. He/she may reside outside the city while in office only with the approval of the Council. (b) No Councilmember or Mayor shall be employed as administrator during the term for which he/she shall have been elected. Williams, Mayor Second Reading ATTEST: Jamie Paul, City Clerk ATTACHMENT #7 Page 2 of 2 ORDINANCE NO. 2023-19 ADOPTING A BUDGET FOR FISCAL YEAR 2024 CONTAINING ESTIMATES OF PROPOSED REVENUES AND EXPENDITURES BY THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, FOR THE BUDGET YEAR BEGINNING JANUARY 1, 2024, AND DECLARING THAT SAME SHALL CONSTITUTE THE BUDGET OF THE CITY OF NORTH AUGUSTA FOR SUCH BUDGET YEAR WHEREAS, in accordance with the Laws of South Carolina, and the Ordinance of the City of North Augusta, the City Administrator must prepare and submit to the City Council a Balanced Budget for the next budget year to begin on January 1, 2024, and end on December 31, 2024; and WHEREAS, a public hearing has been held on said budget, as required by law. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: Section I. The City Council hereby adopts the 2024 Fiscal Year Budget, incorporated by reference as though it were set out herein in its entirety, for the conduct of the business of the municipal government of North Augusta for the budget year, January 1, 2024, to December 31, 2024. Section II. The transfer of budgeted amounts between functional areas of expenditures or expenses shall be approved by City Council; however, transfers of budgeted line items within the functional areas of expenditures or expenses not to exceed $5,000, may be approved by the City Administrator as long as total expenditures or expenses do not exceed appropriations in the functional area. Management can also over expend appropriations, with the City Administrator’s approval, at the line item and department level, as long as the total expenditures or expenses do not exceed appropriations of the functional area. Functional areas are: General Government; Public Safety; Public Works; Parks, Recreation, and Tourism; Sanitation Services; Stormwater Utility; and Water and Wastewater. Section III. The Mayor or City Administrator may authorize the expenditure of an amount not to exceed $500 at any one time from the Council Contingencies Account without prior approval of the City Council provided that any such expenditure is reported in the minutes of the next Council meeting. Section IV. The City Council must approve expenditures from the following funds: Sales Tax III, Sales Tax IV, Accommodation Tax Fund, Fireman’s Fund, Street Improvement Fund, Riverfront Central Core Redevelopment Fund, Tax Increment Financing Fund, Transporation Improvement Fund, Capital Projects Fund, North Augusta Public Facilities Corporation Fund, American Rescue Plan Fund, and the Savannah River Settlement Appropriation Act unless otherwise previously budgeted. Code Section 5-7-30 and Title 6, Chapter 1, Article 3 to impose a business license tax on gross income; and WHEREAS, by Act No. 176 of 2020, known as the South Carolina Business License Tax Standardization Act and codified at S.C. Code Sections 6-1-400 to -420 (the “Standardization Act”), the South Carolina General Assembly imposed additional requirements and conditions on the administration of business license taxes; and WHEREAS, the Standardization Act requires that by December thirty-first of every odd year, each municipality levying a business license tax must adopt, by ordinance, the latest Standardized Business License Class Schedule as recommended by the Municipal Association of South Carolina (the “Association”) and adopted by the Director of the Revenue and Fiscal Affairs Office; and WHEREAS, following the enactment of the Standardization Act, the Municipality enacted Ordinance No. 2021-20 on November 15, 2021, in order to comply with the requirements of the Standardization Act (the “Current Business License Ordinance”); and WHEREAS, the City of North Augusta Council of the Municipality (the “Council”) now wishes to amend the Current Business License Ordinance to adopt the latest Standardized Business License Class Schedule, as required by the Standardization Act, and to make other minor amendments as recommended by the Association. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of North Augusta, as follows: SECTION 1. Amendments to Appendix A. Appendix A to the Current Business License Ordinance, the “Business License Rate Schedule,” is hereby amended as follows: (a) Class 8.3 is hereby amended by deleting the NAICS Codes and replacing them with NAICS 517111, 517112, 517122 – Telephone Companies. (b) Class 8.6 is hereby amended and restated in its entirety to read as follows: “8.6 NAICS Code Varies – Billiard or Pool Tables. A business that offers the use of billiard or pool tables shall be subject to business license taxation under its natural class for all gross income of the business excluding the gross income attributable to the billiard or pool tables. In addition, the billiard or pool tables shall require their own separate business licenses pursuant to SC Code § 12-21-2746 and shall be subject to a license tax of $5.00 per table measuring less than 3½ feet wide and 7 feet long, and $12.50 per table longer than that.” ATTACHMENT #13 Page 1 of 3 SECTION 2. CODE §6-1-950 WHEREAS, The South Carolina Legislature has adopted the South Carolina Development Impact Fee Act (hereinafter the “Act); and WHEREAS, the Act requires the City of North Augusta to have a Comprehensive Plan that complies with the requirement of the South Carolina Local Government Comprehensive Planning Enabling Act of 1994 to enact an impact fee; and WHEREAS, the City of North Augusta adopted a comprehensive plan by Ordinance 2017-07 and updated on June 6, 2022 by adoption of Ordinance 2022-06 that complies with South Carolina Local Government comprehensive Planning Enabling Act of 1994; and WHEREAS, The Council of the City of North Augusta is interested in studying the effect that implementing an impact fee may have on needed improvements caused by increased development; and WHEREAS, it is essential that the public facilities development impact fees be imposed, calculated, and collected uniformly; and WHEREAS, the Act requires that the City of North Augusta have a Capital Improvement Plan (CIP) in place prior to adopting an impact fee; and WHEREAS, the Act provides that the process for considering whether to adopt an impact fee ordinance begins by enaction a resolution directing the North Augusta Planning Commission to conduct studies and recommend an impact fee ordinance.
