PROCLAMATION WORLD PANCREATIC CANCER DAY WHEREAS, in 2022, an estimated 62,210 people will be diagnosed with pancreatic cancer in the United States and 49,830 will die from the disease; and WHEREAS, pancreatic cancer is one of the deadliest cancers, is currently the third leading cause of cancer death in the United States, and is projected to become the second leading cause around 2030; and WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate at just 11 percent; and WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally in later stages, and 91 percent of pancreatic cancer patients die within the first five years; and WHEREAS, approximately 880 deaths will occur in South Carolina in 2022; and WHEREAS, pancreatic cancer is the seventh most common cause of cancer-related death across the world; and WHEREAS, there were an estimated 418,000 new pancreatic cancer cases diagnosed worldwide in 2020; and WHEREAS, the good health and well-being of the residents of the City of North Augusta are enhanced as a direct result of increased awareness about the symptoms and risks of pancreatic cancer, and research into early detection, causes, and effective treatments; and NOW, THEREFORE, I, Briton S. Williams, Mayor City of North Augusta ATTACHMENT #6b Page 1 of 1 ORDINANCE NO. 2022-17 ADOPTING A BUDGET FOR FISCAL YEAR 2023 CONTAINING ESTIMATES OF PROPOSED REVENUES AND EXPENDITURES BY THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, FOR THE BUDGET YEAR BEGINNING JANUARY 1, 2023, AND DECLARING THAT SAME SHALL CONSTITUTE THE BUDGET OF THE CITY OF NORTH AUGUSTA FOR SUCH BUDGET YEAR WHEREAS, in accordance with the Laws of South Carolina, and the Ordinance of the City of North Augusta, the City Administrator must prepare and submit to the City Council a Balanced Budget for the next budget year to begin on January 1, 2023, and end on December 31, 2023; and WHEREAS, a public hearing has been held on said budget, as required by law. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: Section I. The City Council hereby adopts the 2023 Fiscal Year Budget, incorporated by reference as though it were set out herein in its entirety, for the conduct of the business of the municipal government of North Augusta for the budget year, January 1, 2023, to December 31, 2023. Section II. The transfer of budgeted amounts between functional areas of expenditures or expenses shall be approved by City Council; however, transfers of budgeted line items within the functional areas of expenditures or expenses not to exceed $5,000, may be approved by the City Administrator as long as total expenditures or expenses do not exceed appropriations in the functional area. Management can also over expend appropriations, with the City Administrator’s approval, at the line item and department level, as long as the total expenditures or expenses do not exceed appropriations of the functional area. Functional areas are: General Government; Public Safety; Public Works; Parks, Recreation, and Tourism; Sanitation Services; Stormwater Utility; and Water and Wastewater. Section III. The Mayor or City Administrator may authorize the expenditure of an amount not to exceed $500 at any one time from the Council Contingencies Account without prior approval of the City Council provided that any such expenditure is reported in the minutes of the next Council meeting. The City Council must approve expenditures from the following funds: Sales Tax I, Sales Tax II, Sales Tax III, Sales Tax IV, Accommodation Tax Fund, Street Improvement Fund, Riverfront Central Core Redevelopment Fund, Tax Increment Financing Fund, Transporation Improvement Fund, Capital Projects Fund, and the North Augusta Public Facilities Corporation Fund unless otherwise previously budgeted. Section V. The City Administrator may execute all necessary documents relating to the lease purchase financing of equipment specifically authorized and identified in the 2023 Budget. The financial institution selected for 2023 lease purchase financing shall be selected based upon competitive bidding in conformance with the City’s purchasing procedures. Section VI. All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section VII. This Ordinance shall become effective immediately upon its adoption on second reading. The annual tax for the fiscal year (budget year) 2023, beginning January 1, 2023, and ending December 31, 2023, is hereby imposed and levied for general corporate purposes upon all the taxable property of the City of North Augusta. Section II. The period for which the tax levy is due on all taxable property, except for motorized vehicles, shall be from January 1, 2022, to December 31, 2022. Section III. The period for which the tax levy is due for all motorized vehicles which are required to be licensed by Section 53-3-110, Code of Laws of South Carolina, shall be from January 1, 2023, to December 31, 2023. Section IV. The tax levy imposed upon all taxable property shall be 71.70 mills to the General Fund and 3.80 mills to the Capital Projects Fund for a total tax levy of 75.50 mills. Section V. All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section VI. This Ordinance shall become effective January 1, 2023. SANITATION SERVICE Section 14-123. Sanitation Services fees. A.Residential services: There is hereby imposed upon each home, residence, apartment unit, or dwelling unit within the City, a charge for sanitation services to include garbage collection, trash collection, health services, and street sweeping. A sanitation services fee shall also be charged any residential customer located outside the City who receives sanitation services from the City. For purposes of this section, each dwelling unit within a multi-family or apartment complex, duplex, etc. shall be considered a single customer and treated as a single-family dwelling without regard to the method of collection. The City reserves the right to determine the method of collection and type of containers to be used for residential customers. (1)Fees - Residential Roll Carts: Residential services where the principal use is for living, home, residence, apartment unit, dwelling unit and service is provided by roll carts: Inside City limits, per month $21.44 Outside City limits, per month $30.18 For each additional roll cart provided by the City, there shall be a charge equal to 25% of the fee for a single cart. (2)Fees - Removal of Roll Carts from Curb by City Personnel: ATTACHMENT #9 Page 1 of 4 ORDINANCE REVISING ARTICLE IV. SANITATION SERVICE 2 Notwithstanding any other provisions contained herein, if roll carts are left on the street in violation of this Code and City representatives remove the roll carts from the street to a location in compliance with City Code. $5.00 for each removal. (3)Fees – Electronics Disposal Fee: Fees for disposing of electronic waste shall be $25 per item disposed. B.Commercial services: There is hereby imposed upon each place of business, industry, or other commercial premises within the City, a charge for sanitation services to include garbage collection, trash collection, animal control, health services, and street sweeping. A sanitation services fee shall also be charged any commercial customer located outside the City who receives sanitation services from the City. For purposes of this section, a commercial customer is a business or industry having a separate business license and occupying separate spaces. (1)Fees - Commercial service with residential roll carts. Pickups under this subsection shall not exceed six (6) 100 gallon (or equivalent) residential roll carts per pickup and shall not exceed one (1)pickup per week. Per 100 Gal. Pickups under this subsection may be scheduled for Monday through Saturday. The size of container, frequency, and schedule of pickups shall be subject to the approval of the City. Special service for residential or commercial customers: When special bulk or compacted wastes are collected by the City through a procedure or method not provided for above and out of the ordinary collection procedures, the City may charge rates commensurate with the work and equipment involved. D. Special landfill charges: Fees for disposing of automobile, truck, or tractor tires and special handling/packaging waste shall be equal to the fees charged by Aiken County plus 15% for handling. II. This Ordinance shall become effective immediately upon its adoption on third reading for all bills rendered on or after January 1, 2023. III. FOR THE 2022 C-FUND RESURFACING AND ELM STREET REHABILITATION PROJECT WHEREAS, The City of North Augusta has been allocated C-Funds by the Aiken County Transportation Committee (CTC) totaling $672,412.16 for FY 21-22 & FY 22- 23; and WHEREAS, the Engineering Department solicited bids to resurface approximately 1.3 miles of State roads and to rehabilitate Elm Street, a City road approximately 0.05 miles in length; and WHEREAS, on October 6, 2022, two (2) sealed bids were received, publicly opened and read aloud; and WHEREAS, the low bid by Beam’s Contracting, Inc. is in the amount of $424,719.60, which includes $53,691.25 for the Elm Street rehabilitation; and WHEREAS, the Mayor and City Council of the City of North Augusta find that the awarding of such bid is in the best interest of the City. NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof that Beam’s Contracting, Inc. shall be awarded the contract for this project. BE IT FURTHER RESOLVED that the funding sources for this contract shall be from the Street Improvement Fund as follows: Part I. C-Fund Resurfacing $ 371,028.35 (To be reimbursed by SCDOT) Part II. Elm Street Rehabilitation $ 60,000.00 (Unrestricted Fund Balance) BE IT FURTHER RESOLVED that the City Administrator is authorized to execute any documents required for the entering into of this contract. Williams, Mayor ATTEST: Jamie Paul, City Clerk ATTACHMENT #10 Page 1 of 1 RESOLUTION NO. 2022-49 AUTHORIZING FUNDING FOR THE BLUFF AVENUE STREETSCAPE UTILITY RELOCATIONS WHEREAS, Resolution 2021-31 reprioritized the project and funding list for Capital Project Sales Tax IV (CPST IV); and WHEREAS, as a result of Resolution 2021-31 the Road Reconstruction Program was moved to priority position #2, with a total budget allocation of $3,000,000; and WHEREAS, Bluff Avenue is the first priority in the Road Reconstruction Project List as provided on the CPST IV referendum ballot; and WHEREAS, the Bluff Avenue Streetscape includes the “undergrounding” of all overhead utility lines; and WHEREAS, the undergrounding work is to be completed by the respective utility owners, however the City has certain cost obligations associated with that work; and WHEREAS, the City’s cost for such work is estimated to be $180,000. NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof that funding for the Bluff Avenue Streetscape Utility Relocations shall be from the Sales Tax IV Fund, Road Reconstruction Program. Williams, Mayor ATTEST: Jamie Paul City Clerk ATTACHMENT #11 Page 1 of 1 RESOLUTION NO. 2022-50 TO AUTHORIZE THE ISSUING OF A PARADE PERMIT TO NORTH AUGUSTA LIONS CLUB TO CONDUCT THE 2022 CHRISTMAS PARADE ON SUNDAY, DECEMBER 11, 2022 WHEREAS, North Augusta Lions Club has requested a permit to hold a Christmas Parade to celebrate the Christmas Season; and WHEREAS, the request is to hold the parade on December 11, 2022 with the lineup of the parade beginning on Martintown Road, between Knox Avenue and Georgia Avenue. The parade will then proceed on Georgia Avenue beginning at Martintown Road, traveling South and will disperse end at Clifton Avenue; and WHEREAS, the parade will utilize the roadway as identified above with side roads blocked by Public Safety personnel, with spectators on either side of the parade route; and WHEREAS, the parade will involve the usage of the lineup area and parade route from approximately 10:30 AM until 5:00 PM; and WHEREAS, the Mayor and City Council has reviewed the request and finds that the parade permit applied for, at the time requested and upon the roadways as indicated, is not detrimental to the health, safety, welfare or convenience of the residents of the City and, in fact, will benefit the public; and WHEREAS, such request has been timely made and complies with the Code of Ordinances for the City of North Augusta. Williams, Mayor ATTEST: Jamie Paul, City Clerk ATTACHMENT #12 Page 2 of 2 RESOLUTION NO. 2022-51 AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO A CONTRACT ON BEHALF OF THE CITY OF NORTH AUGUSTA WITH DUMPSTER DEPOT TO PURCHASE RECYCLING EQUIPMENT TO BE INSTALLED AT THE MATERIALS RECOVERY FACILITY LOCATED AT 67 CLAYPIT ROAD WHEREAS, on November 25, 2021 a fire at the City’s Materials recovery Facility damaged the electrical system, recycling processing equipment and a portion the buildings structure; and WHEREAS, the City received partial payment totaling $1,736,552 from the South Carolina Insurance and Risk Fund to initiate replacement of the recycling equipment and other damaged assets; and WHEREAS, the City received an offer from Dumpster Depot located in Aiken South Carolina proposing to sell recycling equipment that was manufactured in 2015 that includes conveyors, sort stations, ballistic separator, baler and other related recycling equipment totaling $190,000; and WHEREAS, City staff has inspected such equipment and determined the equipment to be in excellent operating condition, and further estimated the cost to purchase new similar equipment to exceed $1,450,000; and WHEREAS, the Mayor and City Council has determined that it is in the best interest of the City that the City move forward by accepting the offer to purchase recycling equipment from Dumpster Depot ; and NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, that the City Administrator is hereby authorized to enter into a contractual arrangement with Dumpster Depot to purchase recycling equipment as described; and BE IT FURTHER RESOLVED that the funding source shall be from partial payment proceeds received from the South Carolina Insurance and Risk Fund, not to exceed the total amount of $190,000. TO INSTALL RECYCLING EQUIPMENT AT THE MATERIALS RECOVERY FACILITY LOCATED AT 67 CLAYPIT ROAD WHEREAS, on November 25, 2021 a fire at the City’s Materials recovery Facility damaged the electrical system, recycling processing equipment and a portion the buildings structure; and WHEREAS, the City received partial payment totaling $1,736,552 from the South Carolina Insurance and Risk Fund to initiate replacement of the recycling equipment and other damaged assets; and WHEREAS, the City received low bid from A-Lert Construction Services, a division of Centurion Industries, Inc. totaling $137,135 to provide labor and equipment to install conveyors, material sort stations, ballistic separator, baler and other recycling equipment; and WHEREAS, the City in following established practices, has added a 10% contingency for this project, such contingency being in the amount of $13,713.50; and WHEREAS, the Mayor and City Council has determined that it is in the best interest of the City that the City move forward by accepting the bid of A-Lert Construction Services a division of Centurion Industries, Inc.; and NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, that the City Administrator is hereby authorized to enter into a contractual arrangement with A-Lert Construction Services a division of Centurion Industries, Inc. to install recycling equipment as described; and BE IT FURTHER RESOLVED that the funding source shall be from partial payment proceeds received from the South Carolina Insurance and Risk Fund, not to exceed the total amount of $150,848.50.
