Toole, Councilmember • ORDER OF BUSINESS REGULAR MEETING The regular meeting of the City Council of the City of North Augusta of March 21, 2022 having been duly publicized was called to order by Mayor Williams at 6:00 p.m. and also streamed online for public viewing at"City of North Augusta—Public Information" on www.Facebook.com and on the City YouTube page: "City of North Augusta Public Information" then adjourned at 6:25 p.m. Per Section 30-4-80, (e) notice of the meeting by email was sent out to the current maintained "Agenda Mailout" list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Williams rendered the invocation and the Pledge of Allegiance. Members present were Mayor Williams, Councilmembers Brooks, Carpenter, McCauley, McGhee, Presnell, and Toole. • • Also in attendance were James S. Clifford, City Administrator; Rachelle Moody, Assistant City Administrator; Kelly F. Zier, City Attorney; John C. Thomas, Director of Public Safety; Ricky L. Jones, Manager of Information Technology, J.D. McCauley, Manager of Human Resources; and Sharon Lamar, City Clerk. The minutes of the regular City Council meeting of March 7, 2022 and the Study Session of March 14, 2022 were approved by general consent. ITEM S. PROCLAMATION: Disabilities Awareness Month Mayor Williams proclaimed the month of March as Disabilities Awareness Month. Tawanda Baitmon with Tri-Development Center of Aiken County, Inc., was in attendance to accept the proclamation. Also attending from Tri-Development were Raymond Ward, Roderick McKenzie, Barry Shealey, Angela Whaley, Ti'are McCane, Evelyn Lostis, Sara Smith, Cassandra Williams, Amber Murray. PROCLAMATION DISABILITIES AWARENESS MONTH WHEREAS, many North Augusta families are impacted by severe lifelong disabilities including • autism, traumatic brain injuries, spinal cord injuries, and intellectual and related disabilities; and WHEREAS,people with lifelong disabilities are productive citizens, deserving ofrespect and the opportunity,for economic self-sufficiency, independence, and personal growth; and WHEREAS, it is important,for all North Augusta citizens, those with and those without disabilities, work together,play together, worship together, learn together, and grow together; and WHEREAS,family members, caregivers, and service providers selflessly offer daily care, assistance, .supervision, and physical and emotional support to individuals with disabilities to help them enjoyfull participation in community life; and WHEREAS, the 2022 observance of Disabilities Awareness Month celebrates 33 years of advocacy,for and successes ofpeople with disabilities in education, employment, and community activities. NOW, THEREFORE, I, Briton S. Williams, Mayor of the great city of North Augusta, do hereby proclaim March 2022 as DISABILITIES AWARENESS MONTH to encourage all citizens of North Augusta to work together to promote increased opportunities • for people with disabilities, to recognize the many contributions made by people with disabilities • in our communities, and to honor the dedication of the caregivers who bring support and hope to their fellow citizens. ITEM 6 PERSONNEL: Mike Strauss Retirement—Recognition of Service to the City of North Augusta Mayor Williams recognized the retirement of Mike Strauss. During 1990-1991 Mike had an active part of Operation Desert Shield&Desert Storm while serving in Iraq, Saudi Arabia, and Kuwait. In 1992, his unit was deployed to south Florida for assistance in Hurricane Andrew. At the time,the hurricane was the costliest hurricane in our nation's history. In 1994,he was honorably discharged.In 1995,he began serving his community,the City of North Augusta, South Carolina. He has continued to serve for over 27 years as a Police Officer, Fire Firefighter,and Animal Control Officer.Through his hard work and service to the community, he was recognized in the Employee of the Year in 2002 and Public Safety Officer of the Year in 2015. In 2013-2015 he chaired the History of North Augusta Public Safety Book. Mike has served on a number of committees to include the North Augusta Safety Committee and the Employee recognition committee. Since the inception of the Safety Awards program in the year 2000, Mike is one of the very few employees that has not had an avoidable accident or injury. This included over 300,000 miles driven during that time. Mike has been very active in the community. He has coached softball. He has raised a lot of money for . local charities. He has been a coordinator for the Aiken County United Way. He has also been a past commander for North Augusta American Legion Post 71. ITEM 7. EASEMENT: Ordinance No. 2022-05 — To Abandon a Portion of a Water Line Easement Located in Rushing Waters Phase 2 Subdivision; Ordinance—Second Reading On the motion of Councilmember Carpenter, second of Councilmember Toole, Council agreed to consider an ordinance on second reading to abandon a portion of a water line easement located in Rushing Waters, Phase 2 Subdivision. There were no comments from citizens. Council approved the second reading of the ordinance with a unanimous 7-0 vote. Please see a copy of the proposed ordinance below: ORDINANCE NO. 2022-05 TO ABANDON A PORTION OF A WATER LINE EASEMENT LOCATED IN RUSHING WATERS, PHASE 4 SUBDIVISION • • WHEREAS, the City of North Augusta has an unused utility easement in Rushing Waters Phase 2 as shown on plat prepared January 10, 2022 by Southern Partners, Inc. for Rushing Waters, LLC, Exhibit A; and WHEREAS,the City has received a request by Rushing Waters, LLC to abandon the unused water line easement as shown on the referenced plat to facilitate the development of Rushing Waters Phase 2; and WHEREAS, the City Engineer has reviewed the request and determined that the easement requested to be abandoned is not necessary as there is adequate adjacent public right- of-way for the operation and maintenance of the city utilities; and WHEREAS, City Council has determined that this drainage and utility easement is not required for the public's use or convenience and the public interest would best be served by abandoning said section of the drainage easement. NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council for the City of North Augusta, South Carolina, in meeting duly assembled and by the authority of same,that: I. The utility easement as shown on the plat prepared January 10, 2022 by Southern Partners, Inc.for Rushing Waters, LLC, as shown as Exhibit A, is hereby abandoned. • II. All ordinances or parts of ordinance in conflict herewith are,to the extent of such conflict, hereby repealed. III. This ordinance shall become effective immediately upon its adoption on second and final reading. DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS DAY OF 2022. ITEM 8 PUBLIC SERVICES: Resolution No 2022-15—A Resolution Authorizing Expenditure from Insurance Proceeds to Initiate Electrical Repairs at the Materials Recovery Facility On the motion of Councilmember Presnell, second of Councilmember McCauley, Council agreed to consider a resolution authorizingthe expenditure from insurance proceeds to initiate electrical repairs at the Materials Recovery Facility. There were no comments from citizens. Council approved the resolution with a unanimous 7-0 vote. Please see a copy of the proposed resolution below: RESOLUTION NO. 2022-15 A RESOLUTION AUTHORIZING EXPENDITURES FROM INSURANCE PROCEEDS • TO INITIATE ELECTRICAL REPAIRS AT THE MATERIALS RECOVERY FACILITY WHEREAS, on November 25, 2021 a fire at the City's Materials Recovery Facility (MRF) damaged the electrical system, processing equipment and a portion of the building structure; and WHEREAS, the City received an advanced partial payment totaling$500,000 from the South Carolina Municipal Insurance and Risk Financing Fund to initiate replacement of the electrical system and other damaged assets; and WHEREAS, the City solicited sealed bids and has identified the electrical service low bid contractor to be Ireland Electric with a cost totaling $55,425 to replace and install a new 600 AMP electrical service panel, 200 AMP baler transformer, wiring, conduit, receptacles, emergency and warehouse light fixtures. NOW THEREFORE BE IT RESOLVED that the Mayor and City Council for the City of North Augusta in meeting duly assembled and by the authority thereof, hereby authorize electrical repairs at the MRF to commence utilizing Ireland Electric as the primary contractor with total repair costs not to exceed $60,000. BE IT FURTHER RESOLVED, that the City Administrator is authorized to execute all • documents related to the electrical repairs and expenditures will be paid from the MRF operating budget utilizing insurance proceeds from the advanced partial payment deposited into the Sanitation Fund. DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS 211T DAY OF MARCH, 2022. ITEM 9. ADMINISTRATIVE REPORTS City Administrator, Jim Clifford, shared the flag pole on the top of the Municipal Center is not functioning. The City is in the process of contracting with a company to remove the flags. Moving forward the flags will be removed from the top of the building. Staff will return to Council with a plan to relocate the flag pole to the Municipal Center grounds along with resource recommendations.
