REGULAR MEETING
The regular meeting of the City Council of the City of North Augusta of September 16, 2019
having been duly publicized was called to order by Mayor Pro Tem David McGhee at 7:00 p.m.
and adjourned at 7:24 p.m. Per Section 30-4-80, (e) notice of the meeting by email was sent out
to the current maintained"Agenda Mailout" list consisting of news media outlets and individuals
or companies requesting notification. Notice of the meeting was also posted on the outside doors
of the Municipal Center,the main bulletin board of the Municipal Center located on the first floor,
and the City of North Augusta website.
Mayor Pro Tem David McGhee rendered the invocation and the Pledge of Allegiance.
Members present were Councilmembers Brooks, Carpenter, Dickert, McGhee, Presnell, and
Toole. Mayor Pettit was absent.

The minutes of the regular meeting and study session of August 19, 2019, the minutes of the
ENVISION planning meetings of August 26-27, 2019, and the minutes of the study session of
September 9,2019 were approved by general consent.

Mayor Pro Tem David McGhee proclaimed September 17-23,2019 as "Constitution Week."

WHEREAS, our Founding Fathers, including South Carolinians, Pierce Butler,
Charles Pinckney, John Rutledge, and Charles Cotesworth Pinckney, risked their fortunes, and
some even their lives, to secure the blessings of liberty for themselves and their posterity, did
ordain and establish a Constitution for the United States ofAmerica; and
WHEREAS, September 17, 2019, marks the two hundred and thirty-second
anniversary of the drafting of the Constitution of the United States by the Constitutional
Convention; and
WHEREAS, the anniversary of the signing of the Constitution provides an historic
opportunity for all Americans to learn about and recall the achievements of our Founders, and to
reflect on the rights and privileges of citizenship as well as its attendant responsibilities; and
WHEREAS, the independence guaranteed to the American people by the
Constitution should be celebrated by appropriate ceremonies and activities during Constitution
Week, September 17 through 23, 2019, as designated by proclamation of the President of the
United States ofAmerica in accordance with Public Law 915.

Greeneway, South of River Oak Drive,and North of Riverview Park, a Portion of Aiken
County Tax Parcel#003-08-07-001,from CR, Critical Area, to R-14,Large Lot,Single-
Family Residential. Ordinance; Third and final reading.
With the motion of Councilmember Presnell , second by Councilmember Carpenter, Council
agreed to consider an ordinance to amend the zoning map of the City of North Augusta, South
Carolina by rezoning±5.02 acres of land owned by Margaret B. Copenhaver,and located East of
the Savannah River,West of the North Augusta Greeneway, South of River Oak Drive, and
North of Riverview Park, a portion of Aiken County Tax Parcel#003-08-07-001, from CR,
Critical Area,to R-14, Large Lot, Single-Family Residential on third reading. The ordinance
was approved unanimously.

MARGARET B. COPENHAVER, AND LOCATED EAST OF THE SAVANNAH RIVER,
WEST OF THE NORTH AUGUSTA GREENEWAY, SOUTH OF RIVER OAK DRIVE,AND
NORTH OF RIVERVIEW PARK, A PORTION OF AIKEN COUNTY TAX PARCEL#003-
08-07-001.FROM CR, CRITICAL AREA,
TO R-14, LARGE LOT, SINGLE-FAMILY RESIDENTIAL.
Cj WHEREAS, on December 17, 2007, by Ordinance 2007-22, the North Augusta
City Council adopted the North Augusta Development Code and a citywide Zoning Map which is
consistent with the City's North Augusta 2017 Comprehensive Plan; and
WHEREAS,pursuant to Section 5.3,North Augusta Development Code,the North
Augusta Planning Commission may recommend amendments to the Zoning Map, provided such
amendments are consistent with the City's North Augusta 2017 Comprehensive Plan; and
WHEREAS,the North Augusta Planning Commission,following an July 18,2019,
public hearing, reviewed and considered a request by Margaret B. Copenhaver, to amend the
Official Zoning Map of North Augusta from Critical Area (CR) to Large Lot, Single-Family
Residential (R-14). The Planning Commission report has been provided to City Council.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF NORTH AUGUSTA,SOUTH CAROLINA,IN MEETING DULY
ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
I. A parcel consisting of±5.02 acres owned by Margaret B.Copenhaver,located East
of the Savannah River, West of the Greenway, South of River Oak Drive and
North of Riverview Park is hereby rezoned from CR, Critical Area to R-14,Large
Lot,Single-Family Residential. Said property is a portion of Aiken County tax trap
Cparcel#003-08-07-001 and specifically identified on Exhibit"A"attached hereto.
II. The Official Zoning Map for the City of North Augusta is hereby amended to reflect
this rezoning.
III. All ordinances or parts of Ordinances in conflict herewith are,to the extent of such
conflict,hereby repealed.
IV. This Ordinance shall become effective immediately upon its adoption on third and
final reading.

ITEM 7. PERMIT: Resolution No. 2019-28 — To Authorize the Issuine of a Parade
Permit to North Augusta Lions Club to Conduct the 2019 Christmas Parade on Sunday,
December 8,2019
On the motion of Councilmember Toole, second by Councilmember Dickert, Council considered
a resolution to issue a parade permit to the North Augusta Lions Club to conduct the 2019
Christmas Parade on Sunday, December 8, 2019. With no comments or discussion, Council
approved the permit unanimously.

RESOLUTION NO. 2019-28
TO AUTHORIZE THE ISSUING OF A PARADE PERMIT TO
NORTH AUGUSTA LIONS CLUB TO CONDUCT THE 2019 CHRISTMAS PARADE ON
SUNDAY,DECEMBER 8, 2019
WHEREAS,North Augusta Lions Club has requested a permit to hold a Christmas
Parade to celebrate the Christmas Season; and
WHEREAS,the request is to hold the parade on December 8,2019 with the lineup
of the parade beginning on Martintown Road, between Knox Avenue and Georgia Avenue. The
parade will then proceed on Georgia Avenue beginning at Martintown Road,traveling South and
will disperse at Buena Vista Avenue; and
WHEREAS,the parade will utilize the roadway as identified above with side roads
blocked by Public Safety personnel,with spectators on either side of the parade route; and
WHEREAS, the parade will involve the usage of the lineup area and parade route
from approximately 10:30 AM until 5:00 PM; and
WHEREAS, the Mayor and City Council has reviewed the request and finds that
the parade permit applied for, at the time requested and upon the roadways as indicated, is not
detrimental to the health, safety, welfare or convenience of the residents of the City and, in fact,
will benefit the public; and
WHEREAS, such request has been timely made and complies with the Code of
Ordinances for the City of North Augusta.
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the
City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof,
that the request for a permit is approved as follows:
O1. TIME: Approx. 10:30 AM until 5:00 PM
2. DATE: December 8, 2019
3. LOCATION: Martintown Road, between Knox Avenue and Georgia Avenue, as well
as Georgia Avenue beginning at Martintown Road, traveling South to Buena Vista
Avenue.
4. SPECIAL CONDITIONS: The parade will utilize the public roadways which will be
blocked for any other vehicular traffic, to include side roads entering into the parade
route, by Public Safety personnel. Spectators will be allowed to assemble on either
side of the roadway along the parade route.

ITEMS. CITY PROPERTY: Resolution No.2019-29—To Accept,by Deed of Gift,Two
Lots in Aiken County for Future North Augusta Greeneway Expansion
On the motion of Councilmember Brooks, second of Councihnember Carpenter, Council
considered a resolution to accept, by Deed of Gift, two lots in Aiken County for future North
Augusta Greeneway expansion. City Administrator, Todd Glover, explained the lots are being
gifted to the City by North Augusta Forward. Council approved the resolution with no dissenting
votes.

C TO ACCEPT,BY DEED OF GIFT,TWO LOTS IN AIKEN COUNTY FOR
FUTURE NORTH AUGUSTA GREENEWAY EXPANSION
CWHEREAS, North Augusta Forward, a South Carolina, Non-Profit Corporation has
recently purchased two lots that are located adjacent to Mayfield Drive and in close proximity
to the North Augusta Greeneway; and,
WHEREAS,North Augusta Forward purchased these lots anticipating that they could
be utilized to provide additional access to the Greeneway Recreation Trail; and,
WHEREAS,North Augusta Forward now desires to convey said lots to the
City of North Augusta for the purpose of providing additional access to the Greeneway; and,
WHEREAS,the Department of Parks, Recreation and Tourism has reviewed
the lots and determined that they could be beneficial to the City of North Augusta in providing
additional access to the Greeneway; and,
WHEREAS,the Mayor and the City Council find it would be in the City's best
interest to accept said property.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of North Augusta, South Carolina,in meeting duly assembled and by the authority thereof,that
the City accepts, by Deed of Gift, from North Augusta Forward, the following described real
estate to-wit:
All those certain pieces,parcels or tracts of land with the improvements thereon, situate, lying
and being in the County of Aiken, State of South Carolina,being a portion of the Old Central
of Georgia/Norfolk Southern Railroad right-of-way, being shown and designated as LOTS
FORTY-TWO (42) AND FORTY-THREE (43) on a plat of said right-of-way prepared by
William H. McKie, IIII, RLS, dated June 16, 1989, recorded in the Office of the RMC for
Aiken County, South Carolina in Plat Book 22 at pages 106-108. Said property is further
shown on an individual plat prepared by William H. McKie, III, RLS, dated September 30,
1993,recorded in Misc. Book 727 at page 187. Reference is hereby made to said plats for a
more complete and accurate description as to the mete,bounds and exact location of the within
conveyed property.
This is the identical premises conveyed to North Augusta Forward by deed of John A. Barie
dated June 7, 2019, recorded in the Office of the RMC for Aiken County, South Carolina in
Record Book 4786 at page 416.

And,
BE IT FURTHER RESOLVED,that the City of North Augusta specifically accepts
for recording, the Title to Real Estate that is attached hereto, Marked Exhibit "A", and

The City Administrator is directed to forward said Title to Real Estate to the Office of

Sec. 12-11. -Definitions.
As used In this article the following terms shall have the meanings respectively ascribed to
them:
Brush.•AII trees and shrubs under seven (7)feet in height which are not cultivated and cared
for by the person owning or controlling the premises.
Rubbish.•AII refuse, cans, bottles, old vessels of all sorts,junked vehicles or parts thereof,
useless litter, discarded clothing and textiles appliances,tires, and all other discarded things
customarily included in such term.
Weeds.-All rank and uncultivated vegetable growth or matter which has grown to more than
one foot in height,which may give rise to unpleasant odors of noxious vapors, or which is liable to
become a breeding place for mosquitoes and vermin.

Sec. 12-12. - Power of city to declare unsanitary or unsightly properties as nuisances.
Cj It shall be the responsibility of duly authorized codes enforcement officials of the city to
determine certain properties to be unhealthy and/or unsightly or harmful to the citizens of the
city and as such to be nuisances. -

Geospatial Information
A few days ago, I spoke with a reputable insurance
company about the possibility of claims for damages to a
home from natural disasters possibly being denied
because of the failure of a homeowner to execute
corrective measures that might have prevented the
damage. For example: If you have a tree limb which
comes in contact with your roof and the limb results in
damage which could have been prevented if you had
removed the limb. Insurance companies can deny the
claim if they can prove the individual failed to take action
to prevent the damage.
Thanks to Geospatial Information insurance companies
now have a way to make this type of assessment and
they will use these assessments to save money on claims.

I think it is a great idea because it will penalize people
who attempt to submit fraudulent claims or simply fail to
take care of their property and maybe slow down the
constant creep of rate increases.
Announcements:
• I'd like to remind everyone that if you are interested in applying for the
North Augusta Hometown Heroes program, the deadline is this
Friday, September 20. This is a great new program to honor current
and former military members with banners recognizing their service.
You can get more information and the application on the city's
website.
• Also, I want to make sure everyone knows that due to significant
warm weather, the Public Services Department will continue
mosquito spraying through October 4. This is an extra 30 days past
the normal spray schedule. Additionally, we have created a new form
on the city website if you would like to request mosquito spraying in a
specific area or neighborhood. The form is simple to fill out, and we
encourage you to provide contact information in case staff needs to
contact or follow up with you.
