McGhee, Councilmember ORDER OF BUSINESS REGULAR MEETING The regular meeting the City Council of the City of North Augusta of Much 18, 2019, having been duly publicized,was called to order by Mayor Pettit at 7:03 p.m. and adjourned at 9:05 p.m. Per Section 30-4-80(e) notice of the meeting by email was sent out to the current maintained "Agenda Mailout" list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Pettit rendered the invocation and led in the Pledge of Allegiance. Members present were Mayor Pettit and Councilmembers Adams,Carpenter,Dickert,McDowell, and McGhee. Councilmember Brooks was absent. CAlso in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney; Cammie T. Hayes, Director of Finance; Richard L. Meyer, Director of Parks, Recreation, & Tourism;John C. Thomas, Director of Public Safety; Thomas C. Zeaser, Director of Engineering C and Public Works; James E. Sutton, Director of Public Services; Lillian E. (Libby) Hodges, Director of Planning and Development; J. D. McCauley, Manager of Human Resources; and Sharon Lamar, City Clerk. The minutes of the regular meeting and study session of March 4,2019 were approved by general consent. ITEM 5: PARKS. RECREATION & TOURISM: Resolution No.2019-10—A Resolution Providing Findings about the Hamburg Incident of 1876 and Appointing Members of a Committee to Evaluate Options for an Additional Display in John C. Calhoun Park On motion by Mayor Pettit, second by Councilmember McGhee, Council considered a resolution to provide findings about the Hamburg Incident of 1876 and appoint members of a committee to evaluate options for an additional display in John C. Calhoun Park. On motion of Mayor Pettit, second by Councilmember Dickert, the original resolution was amended by a unanimous vote to omit the following paragraph: "A discussion of the accomplishments of the African-American citizens during Reconstruction to include the founding of Aiken County, and the Jim Crow and Civil ORights eras, and" Councilmember McDowell requested that the resolution be read aloud to all in attendance. Mayor Pettit read the resolution. Public comments were made by: H. RESOLUTION NO. 2019-10 A RESOLUTION PROVIDING FINDINGS ABOUT THE HAMBURG INCIDENT OF 1876 AND APPOINTING MEMBERS OF A COMMITTEE TO EVALUATE OPTIONS FOR AN ADDITIONAL DISPLAY IN JOHN C. CALHOUN PARK C WHEREAS, Thomas McKie Meriwether died during a confrontation between an armed African-American militia positioned in the second story of the Sibley Building and a O large group of armed white citizens in and around the Town of Hamburg, South Carolina on July P, 1876 and WHEREAS, seven African-American men died in the confrontation, five of whom were murdered, and WHEREAS,the Monument to Thomas McKie Meriwether was unveiled on February 16, 1916 and located prominently in John C. Calhoun Park, and WHEREAS,the monument was paid for with an authorization of$400 from the South Carolina Legislature and local contributions, and WHEREAS,there is no recognition in John C. Calhoun Park of the seven African-American men who died during the Hamburg incident, and WHEREAS,both John C. Calhoun Park and the now abandoned Town of Hamburg me within the City of North Augusta, and NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta,in meeting duly assembled and by the authority thereof,reach these conclusions: The Thomas McKie Meriwether Monument should remain in its present location,its text and structure should not be altered, and C/ The Monument to Thomas McKie Meriwether contains text offensive to, and inconsistent with the beliefs of, current day North Augusta citizens, and A defined, distinct area surrounding the monument should be created providing educational opportunities for visitors as a counterpoint to the viewpoint expressed by the text on the monument, and The educational display having permanently installed features (e.g., sculptures, kiosks, plaques, etc.)should present the information and should include, as a minimum, A summary of the events which transpired at Hamburg on July 8th and 91", and The names of the African-American men killed during the events of July 8a' and 9h, and BE IT FURTHER RESOLVED that a committee comprised of the following individuals is hereby established for the purpose of developing a plan for the additions at John C. A design competition for the overall layout and specific elements should be considered by the Committee. Should this be the recommended approach,the Committee is authorized to develop the overall guidelines for such competition, including a recommended selection procedure and the criteria. C Committee recommendations shall be presented to Council for approval and implementation. The City Administrator is authorized to approve funds to cover travel and other expenses from General Fund City Council Contingency Account totaling not more than$500. Such Text Amendments Related to Article 3.6.4.5.2 Development Standards and 3.8.1.1 Applicability/Corridor Overlay Districts With a motion by Councilmember McDowell,second by Councilmember McGhee,council considered a resolution to direct the City Administrator to file an application requesting text amendments of the North Augusta Development Code. Such text amendments are related to Article 3.6.4.5.2 Development Standards and 3.8.1.1 Applicability/Corridor Overlay Districts. City attorney, Kelly Zier, summarized the proposed amendments. Councilmember McDowell requested that the resolution be read aloud to all in attendance. Mayor Pettit read the resolution. As a brief review of the site: 3 parcels, ±4.45 acres 0.22 ac, R-14 2.19 ac, R-14 2.04 ac, GC - all are in the "Neighborhood Protection Overlay" district. 1) Rezoning. (Timeline: 30-60 days) This process would be heard by the Planning Commission. a. To be used as Fire/Police protection, the property must be rezoned to "P," Public Use Districts, per Table 3-7 and Section 3.6.4. The following review criteria are required for the "P" Zoning: i. 3.6.4.5.1 Review Criteria for Rezoning — In reviewing an application for a proposed P, Public Use District, the Planning Commission and City Council shall consider the following: 1. Inter-jurisdictional Analysis — A review to determine the extent to which an interjurisdictional approach may be appropriate, including consideration of possible alternative sites for the facility in other jurisdictions and an analysis of the extent to which the proposed facility is of a citywide, countywide, regional or state-wide nature, and whether uniformity among jurisdictions should be considered. 2. Financial Analysis — A review to determine if a negative financial impact upon the City of North Augusta can be reduced or avoided by intergovernmental agreement. 3. Special Purpose Districts — When the public facility is being proposed by a special purpose district including a school district, the city should consider the facility in the context of the district's overall plan and the extent to which the plan and facility are consistent with the Comprehensive Plan. 4. Measures to Facilitate Siting — The factors that make a particular facility difficult to site should be considered when a facility is proposed, and measures should be taken to facilitate siting of the facility in light of those factors including, but not limited to: a. The availability of land; b. Access to the transportation network; c. Compatibility with neighboring uses; and d. The impact on the physical environment. 2) Development Standards (development review process 30 to 180 days, depending on applicant responsiveness and variance/waiver processes). The Planning Commission would review the site plan only if the building is over 40,000 sq ft., otherwise it is an administrative process, aside from any waivers or variances required. a. Per NADC 3.6.4.5.2, Uses within the P, Public Use District, are not subject to the dimensional standards of §3.5. However, such uses are subject to the landscaping standards of Article 10, and the parking standards of Article 12. If the use is within a corridor overlay district, the standards of §3.8 apply. I assume that this means that any requirement within this district would apply. s / TzLE cam- < LcAI_ AJ I VA 3) Based on the plan reviewed, several variances would be required (Timeline: 30 days). Each variance would be reviewed separately, but would be presented at the same hearing, and would be heard by the Board of Zoning Appeals per NADC 18.4.1 believe the following variances would be required, at a minimum: a. Based on 3.8.6.2 and 3.8.6.2.1, 1 believe there is some room for interpretation on how the second floor is used, based on the non-commercial use of the property; additional research may be needed. b. No existing structure may be demolished until a site plan is approved. I believe a feasibility study has already been completed. There may be some room for demolition is it is an immediate matter of life and safety. c. Setbacks: a minimum setback is 25' and a maximum setback is 50'. It does not appear the building meets this setback. Using 3.5.8 as a guide for the corner lot setbacks, Observatory should have a setback of approximately 45' (this will need to be confirmed by a survey); the Fire Station may meet that setback. Butler Ave. setback should be approximately 60', which is h. Parking will be determined at permitting per table 12-1. i. The remaining landscaping is not available for review at this time. For the Board of Zoning Appeals hearings, I believe it is helpful to also understand the findings that must be made to issue a variance: a. A variance is not a right. It may be granted to an applicant only if the applicant establishes compliance with the hardship criteria established in S.C. Code §6-29-800. b. The Board of Zoning Appeals shall hear and decide appeals for variances from the requirements of Article 3, Zoning Districts, and Article 13, Signs, when strict application of the regulations would result in unnecessary hardship variance may be granted in an individual case of unnecessary hardship if the Board of Zoning Appeals makes and explains in writing, all of the following: z. 1. An unnecessary hardship exists; T � 7 v n nGce.S s� 2. There are extraordinary and exceptional conditions pertaining to the particular piece of property; 3. The conditions do not generally apply to other property in the vicinity; 4. Because of the conditions, the application of this Chapter to the particular piece of property would effectively prohibit or unreasonably restrict the utilization of the property; and 5. The authorization of a variance will not be of substantial detriment to adjacent property or to the public good, and the character of the district will not be harmed by the granting of the variance. Harm to the character of the district may include structures that are significantly out of scale, and the creation or potential for the creation of excessive noise, light, traffic or incompatible late night activity. (Rev. 12-1-08; Ord. 2008-18) c. In the approval of an application for a variance from the provisions of Article 13, Signs, regulating the size, height, appearance, or location of a sign, the Board of Zoning Appeals shall also find that no alternative signage solution that complies with the provisions of Article 13 is available and would provide adequate visibility, recognition and understanding. d. The Board of Zoning Appeals may not grant a variance the erect of which would be: To allow the establishment of a use not otherwise permitted in a zoning district. 2. To extend physically a nonconforming use of land. 3. To change zoning district boundaries shown on the official zoning map. e. If the unnecessary hardship is self-imposed by the applicant the variance should not be granted. f. The fact that property may be utilized more profitably, should a variance,be granted, shall not be considered grounds for a variance. g.
