Dickert, Councilmember Kenneth J McDowell, Councilmember David W McGhee, Councilmember ORDER OF BUSINESS REGULAR MEETING The regular meeting of December 17, 2018, having been duly publicized, was called to order by Mayor Pettit at 7:05 p.m. and adjourned at 8:50 p.m. Per Section 30-4-80(e) notice of the meeting by email was sent out to the current maintained "Agenda Mailout" list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Pettit rendered the invocation and read the Christmas story. Mayor Pettit asked Philip Miller of Boy Scout Troop 7 to lead in the Pledge of Allegiance. Members present were Mayor Pettit and Councilmembers Brooks, Carpenter, Dickert, McDowell and McGhee. Councilmember Adams was out of town. Also in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney; Cammic T. Hayes, Director of Finance; Richard L. Meyer, Director of Parks, Recreation, & Minutes of Regular Meeting of 12/17/18 Tourism; John C. Thomas, Director of Public Safety; Thomas C. Zeasey Director of Engineering and Public Works; James E. Sutton, Director of Public Services; Lillian E. (Libby) Hodges, Director of Planning and Development; J. D. McCauley, Manager of Human Resources; and Donna B. Young, City Clerk. The minutes of the regular and study session minutes of December 3, 2018, were approved by general consent. ITEM 1. PERSONNEL: Donna B. Young — Recognition of Service to the City of North Augusta On December 26, 2018, Donna B. Young, City Clerk, will retire with the City of North Augusta. Donna began her employment with the City of North Augusta in June of 1999 as the City Clerk. Mayor Pettit recognized and honored Donna for her years of service to the City of North Augusta. ITEM 2. PERSONNEL: Employee of the Ouarter, October. November, and December, 2018 — Kina McBride, Dispatcher witb the Department of Public Safety Mayor Pettit recognized the employee of the quarter for October, November, and December, 2018, Kina McBride, Dispatcher with the Department of Public Safety. Kina started her employment with the City of North Augusta on July 1, 2015. Dispatcher McBride always has a good attitude about the work that she is tasked with. She makes it a priority to listen to the radio traffic and answer the phones as quick as possible so that she can help the citizens of North Augusta in a timely manner. In addition to these duties, Kina enters warrants at the beginning of her shift and continues to work on them as needed throughout the remainder of her shift. Another part of Kina's job is that she is an assistant terminal agency coordinator which involves ensuring that all SLED policies are followed that relate to the National Crime Information Center. Kina McBride's initiative and effort in doing her job as dispatcher is very noticeable to her fellow employees. She is very helpful to her co-workers and officers on the shift. Her attitude does not change regardless of the activity level. Countless times Kina has stayed well past her scheduled hours to make sure that the oncoming dispatcher is caught up prior to her leaving. The constant desire to help people and great attitude at work are what sets Dispatcher Kina McBride above and beyond. Minutes of Regular Meeting of 12/17/18 Kina McBride is a tremendous asset to the Department of Public Safety and the City of North Augusta workforce. Congratulations to Kina McBride, our employee of the fourth quarter of 2018. Mayor Pettit presented her with a plaque, a$25 gift certificate to Your Pie, and a $25 gift cud to Wal-Mart. ITEM 3. ZONING: Ordinance No. 2018-14 — An Ordinance to Amend the Zonin Map of the City Of North Augusta, South Carolina by Rezoning ±67.57 Acres of Land Owned by the Summers Family Trust, and Located Along Austin Gravbill Road Between Orchard Way and Fox Trail Drive,Aiken County Tax Parcel # 011-05-01-001 from R-10, Medium Lot Residential to R-7, Small Lot, Single Family Residential - Ordinance. Third and Final Reading On motion by Councilmember Dickert, second by Councilmember Carpenter, Council unanimously adopted an ordinance on third and final reading to amend the Zoning Map of the City of North Augusta, South Carolina by rezoning±67.57 acres of land owned by the Summers Family Trust and located along Austin Graybill Road Between Orchard Way and Fox Trail Drive, and identified as Aiken County Tax Parcel 4011-05-011-001, from R-10, Medium Lot Residential to R-5, Mixed Residential. CITY CODE: Ordinance No. 2018-02 — An Ordinance Amending Section 4.1 of the Code of Laws for the City of North Augusta Entitled "Consumption of Alcoholic Beverages in Public"— Ordinance, Third and Final Reading On motion by Councilmember McDowell, second by Councilmember McGhee, Council adopted an ordinance on third and final reading amending Section 4.1 of the Code of Laws for the City of North Augusta entitled Consumption of Alcoholic Beverages in Public. Voting for the ordinance on third and final reading were Mayor Pettit and Councilmembers Dickert, McDowell, and McGhee. Voting against the ordinance on third and final reading were Councilmembers Brooks and Carpenter. The ordinance passed on third and final reading with a 4/2 vote. FINANCE: Ordinance No. 2018-15 — An Ordinance Relating to the Recovery of Collection Costs as a Part of Delinquent Debts Collected Pursuant to the Setoff Debt Collection Act—Ordinance. First Reading On motion by Councilmember Carpenter, second by Councilmember McGhee, Council unanimously passed an ordinance on first reading relating to the recovery of collection costs as part of delinquent debts collected pursuant to the Setoff Debt Collection Act. ORDINANCE NO. 2018-15 AN ORDINANCE RELATING TO THE RECOVERY OF COLLECTION COSTS AS A PART OF DELINQUENT DEBTS COLLECTED PURSUANT TO THE SETOFF DEBT COLLECTION ACT WHEREAS, the City of North Augusta, South Carolina is a claimant agency as defined in the Setoff Debt Collection Act, S.C. Code Ann. § 12-56-10, et seq. (the Act) and is therefore entitled to utilize the procedures set out in the Act to collect delinquent debts owed to the City of North Augusta, South Carolina; and WHEREAS, "delinquent debt' is defined in the Act to include "collection costs, court costs, fines, penalties, and interest which have accrued through contract, subrogation, tort, operation of law, or any other legal theory regardless of whether there is an outstanding judgment for that sum which is legally collectible and for which a collection effort has been or is being made;" and WHEREAS, the City of North Augusta, South Carolina has contracted with the Municipal Association of South Carolina to submit claims on its behalf to the SC Department of Revenue pursuant to the Act; and WHEREAS, the Municipal Association of South Carolina charges an administrative fee for the services it provides pursuant to the Act; and WHEREAS, the administrative fee charged by the Municipal Association of South Carolina is a cost of collection incurred by the City of North Augusta, South Carolina that arises through contract, and is therefore properly considered as a part of the delinquent debt owed to the City of North Augusta, South Carolina as that term is defined in the Act; and WHEREAS, the City of North Augusta, South Carolina also incurs internal costs in preparing and transmitting information to the Municipal Association, which costs are also collection costs that are a part of the delinquent debt owed to the City of North Augusta, South Carolina; and Minutes of Regular Meeting of 12/17/18 WHEREAS, the City of North Augusta, South Carolina may desire to recover its internal costs of collection by adding such costs to the delinquent debt; NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, that: 1. The City of North Augusta, South Carolina may impose a collection cost of up to $25.00 to defray its internal costs of collection for any delinquent debts that are sought to be collected pursuant to the provisions of the Setoff Debt Collection Act, S.C. Code Ann. § 12-5610 et. seq. This cost is hereby declared to be a collection cost that arises by operation of law and shall be added to the delinquent debt and recovered from the debtor. 2. The City of North Augusta, South Carolina hereby declares that the administrative fee charged by the Municipal Association of South Carolina is also a collection cost to the City/Town, which shall also be added to the delinquent debt and recovered from the debtor. 3. All Ordinances in conflict with this Ordinance are hereby repealed. 4. This Ordinance shall be effective on the date of final reading, provided however, that this ordinance is declared to be consistent with prior law and practice and shall not be construed to mean that any fees previously charged to debtors as costs of collection under the Act were not properly authorized or properly charged to the debtor. Minutes of Regular Meeting of 12/17/18 ITEM 7: FINANCE: Resolution No. 2018-31 — A Resolution to Authorize the Municipal Association of South Carolina to act as a Claimant Agencv for the Collection of Debt on Behalf of the City of North Augusta in Accordance with the Setoff Debt Collection Act On motion by Councilmember McDowell, second by Councilmember McGhee, Council unanimously tabled Resolution No. 2018-31. Prior to this resolution being rescheduled for removal from the table, City Attorney, Kelly Zier, will contact the Municipal Association of South Carolina to clarify our understanding of entering into agreements containing indemnification clauses. ITEM 8. MATERIALS RECOVERY FACILITY: Resolution No. 2018-32 — A Resolution for Authorization of Funding to Replace the Conveyer at the Materials Recovery Facility and Acceptance of the Low Bid from Metaltech Systems, Inc. to Perform Such Services On motion by Councilmember McDowell, second by Councilmember McGhee, Council unanimously passed a resolution for authorization of funding to replace the conveyer at the Materials Recovery Facility and acceptance of the low bid from Metaltech Systems, Inc. to perform such services. The resolution text is as follows: Please note that all complete exhibits and attachments are available in the Office ojthe City Clerk RESOLUTION NO. 2018-32 AUTHORIZATION OF FUNDING TO REPLACE THE CONVEYOR AT THE MATERIALS RECOVERY FACILITY AND ACCEPTANCE OF THE LOW BID FROM METALTECH SYSTEMS INC.TO PERFORM SUCH SERVICES WHEREAS, a fire occurred at the Materials Recovery Facility on September 3rd 2018; and WHEREAS, the main solid waste conveyor system was structurally damaged as well as various walls and electrical components of the facility; and WHEREAS,the original conveyor system was installed in 1993; and WHEREAS, due to the age of the conveyor system and the damage from the fire it is in the best interest of the City to replace the conveyor system to avoid substantial reoccurring repair costs; and WHEREAS, the total estimated costs to repair the fire damage and replace the conveyor system is not to exceed$180,000; and Minutes of Regular Meeting of 12/17/18 WHEREAS, sealed bids were received and opened on December 3's, 2018 for replacement of the conveyor system;and WHEREAS, the apparent low bidder is MetalTech Systems, Inc. with a bid of$145,704; and WHEREAS, insurance proceeds of$156,204.34 were received during 2018; and WHEREAS, additional funding of$23,795.66 is needed to complete the project. NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby authorize total funding not to exceed $180,000 for Ore damage repair of the Material Recovery Facility and replacement of the conveyor system with funding from insurance proceeds from the fire and the Sanitation Fund balance. STREETS AND DRAINS: Resolution No. 2018-33 A Resolution Authorizing the Execution of a Contract for Wayfrnding Planning and Design Services On motion by Councilmember McGhee, second by Councilmember Dickert, Council considered a resolution authorizing the execution of a contract for Wayfinding Planning and Design Services. On motion by Councilmember McDowell, second by Councilmember Dickert, a motion to amend the resolution by adding the following italicized language after the 4's whereas. WHEREAS, staff determined that Kerestes-Martin Associates Design of Carnegie, Pennsylvania ("KMA") are the most qualified respondents to perform the Services and include no less than the tasks listed in Task 1 and Task 2 of the KMA contract; and The motion to amend passed unanimously. Vote was then taken on the resolution,as amended, and it passed unanimously. RESOLUTION NO. 2018-33 AUTHORIZING THE EXECUTION OF A CONTRACT FOR WAYFINDING PLANNING AND DESIGN SERVICES Minutes of Regular Meeting of 12/17/18 WHEREAS, the City has recognized the need for consulting and design services (the "Services") to assist in planning and design of wayfinding signage and wayfinding implementation plan for the City; and WHEREAS, the City issued a request for proposals (RFP) for firms to submit proposals for wayfinding design and consultation services;and WHEREAS, an RFP, "Wayfinding Signage Plan" was properly advertised on the City's website and four firms submitted proposals; and WHEREAS, staff determined that Kerestes-Martin Associates Design of Carnegie, Pennsylvania ("KMA") are the most qualified respondents to perform the Services and include no less than the tasks listed in Task 1 and Task 2 of the KMA contract;and WHEREAS, staff have determined that it is in the public interest to enter into an agreement with KMA for the Services. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council that the City Administrator is authorized to execute contracts by and between the City of North Augusta and KMA for consulting and design services for wayfinding signage in the City in the amount of$28,027.50. Mayor Pettit also wanted to acknowledge that the Mayor and several Councilmembers were in attendance at Grace United Methodist Church on December 16. 2018, to participate in and attend a Lessons and Carols Event. It was emphasizes to us that there would be a wooded border and fencing to ensure the safety and integrity for existing property owners. He also said all utilities would be underground the way surrounding areas are. Since he requested the zoning to be raised to 7 not 5 he is certainly showing he is trying to meet our concerns since surrounding older subdivisions are 10 or the equivalent rating the county has. I am not sure what Wadley Place is. WE appreciate some of you recognizing our concerns were valid and hope the expectations of all parties will be carried out. In the future I hope you will visit the 7 zoning which I understand allows duplexes on small lots. That still remains a concern for this and future developments and puts the possibility of more that 2 cars to be allowed to park on a small lot. Streets are narrow enough without having cars to be continually park in them creating a safety hazard for walkers and cars alike. At that time, I questioned Council how it was determined that we, as a city, felt this ordiance was necessary. In that City Council meeting, Mr. Dave Leverett asked if this ordinance was our idea or the restaurants associated with Riverside Village. The Mayor's response was that it was "our idea". I feel I need to ask this question. Does the reply, "our idea" mean that this new ordinance is being driven by City Council? If it is indeed being initiated by our City Council, I am very disappointed in the direction that you have taken. Since the December 31d meeting, I have learned that the State of South Carolina ranks #2 in the nation for drunk driving deaths (per capita). I also learned that Charleston, Columbia, Greenville and Myrtle Beach do not allow open containers of alcoholic drinks on the streets except for special events. This ordinance, as proposed, will allow public consumption of all alcoholic beverages (not just beer and wine) 7 days/week from 10:OOAM to midnight. Here we are on the third and final reading where you're being aked to approve this new ordinance. I still don't know why you are entertaining approving this ordinance. Could you please tell the citizens who are here tonight and those watching via the Internet why you as a council have chosen to initiate this ordinance? Even the new Mercedes stadium in Atlanta has a policy restricting times of alcohol sales and consumption. Removal of alcohol from the stadium is not allowed. I have attached their policy to go on record. This stadium has hosted many national events already with this rule in place. I think we would all agree that Atlanta is a fairly progressive city compared to North Augusta. I'm sure many of you are aware of our city's Alcohol Anonymous organization. In fact, just around the corner from the proposed public drinking area boundary, daily meetings (7 days/wk.) are held for AA members. I think it is very disrespectful to the members of this community who are daily living with this temptation to be subjected to this environment on the way to/from AA meetings. What if they were your family members? Would't you want to create an environment that could only help them to be successful? I realize that alcohol consumption is generally accepted in our society. As with many things in life, there is a time and place. I just feel the public steets in North Augusta are not the place. Let drinking occur as currently allowed in North Augusta.
