Whinghter, Councilmember ORDER OF BUSINESS PUBLIC HEARING The public hearing of October 15, 2012, having been duly publicized, was called to order by Mayor Jones at 7:00 p.m. The purpose of the public hearing was to receive comments from the citizens of North Augusta pertaining to the proposed Consolidated Budget for Fiscal Year 2013. Members present were Mayor Jones and Councilmembers Adams, Carpenter, McDowell, and Shealy. Councilmember Baggott was absent. Councilmember Whinghter was absent due to a work commitment. Also in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney; John P. Potter, Jr., Director of Finance; Richard L. Meyer, Director of Parks, Recreation, and Leisure Services; Scott L. Sterling, Interim Director of Planning and Economic Development; John C. Thomas, Director of Public Safety; Thomas C. Minutes of Regular Meeting of 10/15/12 Pamela J. Stickler, representing the RECing Crew, requested that Mayor and Council reconsider their organization for funding. There being no other comments; the meeting was adjourned. ANNEXATION: Property located North of Bradleyville Road, Tax Parcel Number 012-14-06-046, 2.00 f Acres, Owned by Behind the Veil Ministries — Ordinance, Third and Final Reading On motion by Councilmember Shealy, second by Councilmember Adams, Council unanimously adopted an ordinance to effect the annexation of 2.00 ± acres located North of Bradleyville Road, and owned by Behind the Veil Ministries. This property is identified as Tax Parcel Number 012-14-06-046. The zoning classification recommended for this property, R-7, Small Lot, Single Family Residential, is consistent with the future land use classification of the property, as specified in the Future Land use Element of the 2005 Comprehensive Plan. Please see the minutes of October 1, 2012, for the ordinance text. Minutes of Regular Meeting of 10/15/12 ITEM 2. FINANCE: Amendment of the Business License Ordinance Provisions for Insurance Companies— Ordinance, First Reading On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously passed on first reading an ordinance to amend the Business License Ordinance Provisions for Insurance Companies. This ordinance is as a result of legislation passed in the 2012 session of the South Carolina General Assembly. The ordinance text is as follows: ORDINANCE NO. 2012-15 AN ORDINANCE Amending the Business License Ordinance Provisions for Insurance Companies WHEREAS, the South Carolina General Assembly, in order to ensure consistency with the federal Non-admitted and Reinsurance Reform Act of 2010 ("NRRA"), ratified an act (Rat# 283) on June 28, 2012, amending S.C. Code §§ 38-7-16 and 38-45-10 through 38-45-195; and WHEREAS, the act establishes a blended broker's premium tax rate of 6 percent comprised of a 4 percent state broker's premium tax and a 2 percent municipal broker's premium tax; and WHEREAS, the act states a municipality may not impose on brokers of non- admitted insurance in South Carolina an additional license fee or tax based upon a percentage of premiums; and WHEREAS, the act authorizes the Municipal Association of South Carolina to act as the municipal agent for purposes of distributing to municipalities the municipal broker's tax collected by the South Carolina Department of Insurance; and WHEREAS, it is necessary to amend the Business License Ordinance to conform to the State law as amended; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of North Augusta, that the Business License Ordinance is amended by changing the provisions for insurance companies as follows: Minutes of Regular Meeting of 10/15/12 SECTION 1. SIC NAICS CODE or CODE 63 5241 Insurance Companies: Except as to fire insurance, "gross premiums" means gross premiums written for policies for property or a risk located within the municipality. In addition, "gross premiums" shall include premiums written for policies that are sold, solicited, negotiated, taken, transmitted, received, delivered, applied for, produced or serviced by (1) the insurance company's office located in the municipality, (2) the insurance company's employee conducting business within the municipality, or (3) the office of the insurance company's licensed or appointed producer(agent) conducting business within the municipality, regardless of where the property or risk is located, provided no tax has been paid to another municipality in which the property or risk is located based on the same premium. Solicitation for insurance, receiving or transmitting an application or policy, examination of a risk, collection or transmitting of a premium, adjusting a claim, delivering a benefit, or doing any act in connection with a policy or claim shall constitute conducting business within the municipality, regardless of whether or not an office is maintained in the municipality. As to fire insurance, "gross premiums" means gross premiums (1) collected in the municipality, and/or (2) realized from risks located within the limits of the municipality. Gross premiums shall include all business conducted in the prior calendar year. Gross premiums shall include new and renewal business without deductions for any dividend, credit, return premiums or deposit. Notwithstanding any other provisions of this ordinance, license taxes for insurance companies shall be payable on or before May 31 in each year without penalty. The penalty for delinquent payments shall be 5% of the tax due per month, or portion thereof, after the due date until paid. SECTION 3. Any exemptions in the business license ordinance for income from business in interstate commerce are hereby repealed. Gross income from interstate commerce shall be included in the gross income for every business subject to a business license tax. SECTION 4. Pursuant to S.C. Code Ann. §§ 38-45-10 and 38-45-60, the Municipal Association of South Carolina is designated the municipal agent for purposes of administration of the municipal broker's premium tax. The agreement with the Association for administration and collection of current and delinquent license taxes from insurance companies as authorized by S.C. Code § 5- 7-300 and administration of the municipal broker's premium tax in the form attached hereto is approved, and the Mayor is authorized to execute it. All ordinances in conflict with this ordinance are hereby repealed. This ordinance shall be effective on the date of final reading. ITEM 3. FINANCE: Amendment of the Business License Ordinance Provisions for Insurance Companies— Ordinance, Second Reading On motion by Mayor Jones, second by Councilmember Adams, Council unanimously passed on second reading an ordinance to amend the Business License Ordinance Provisions for Insurance Companies. ITEM 4 FINANCE• Custom Street Light Fees, Fiscal Year 2013 — Ordinance, First Reading On motion by Councilmember McDowell, second by Mayor Jones, Council unanimously passed on first reading an ordinance changing the custom street light fee from $1.65 per month to $2.05 per month to be imposed upon each residential customer located within a subdivision of the City served by decorative street lights. This custom street light fee will become effective for all bills rendered on or after January 1, 2013. Minutes of Regular Meeting of 10/15/12 The ordinance text is as follows: ORDINANCE NO. 2012-16 AMENDING CHAPTER 19, TITLED " STREETS, SIDEWALKS AND PUBLIC PLACES*" OF THE CITY CODE OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA BY ADDING SECTION 19-25 TITLED "CUSTOM STREET LIGHT FEES" BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: I. Chapter 19 titled "Streets, Sidewalks and Public Places*", Section 19-25, titled "Custom Street Light Fees" is hereby adopted and when adopted shall read as follows: CHAPTER 19. STREETS, SIDEWALKS AND PUBLIC PLACES* Section 19-25. Custom Street Light Fees. There is hereby imposed upon each residential customer located within a subdivision of the City served by decorative street lights a charge for custom street lights of$2.05 per month. For purposes of this section, the definition of residential shall be as previously defined. II. This Ordinance shall become effective immediately upon its adoption on third and final reading for all bills rendered on or after January 1, 2013. III. Minutes of Regular Meeting of 10/15/12 ITEM 5 FINANCE• Proposed Annual Consolidated Budget for Fiscal Year 2013 — Ordinance, First Reading On motion by Mayor Jones, second by Councilmember McDowell, Council considered an ordinance on first reading to adopt the proposed Fiscal Year 2013 Consolidated Budget. On motion by Councilmember Shealy, a motion to allocate $500.00 from the Council Contingency Fund to the RECing Crew was made. The motion failed because of a lack of a second. On motion by Mayor Jones, second by Councilmember Carpenter, a motion to add the words Sales Tax III in Section IV was unanimously passed. Section IV. The City Council must approve expenditures from the Sales Tax I Fund, the Sales Tax II Fund, Sales Tax III Fund, the Street Improvements Fund, the Transportation Improvement Fund, the Community Development Fund, the Capital Projects Fund, the Riverfront/Central Core Development Fund, the Public Utilities Depreciation Fund, the Public Utilities Contingent Fund, Public Utilities Construction Fund, Tax Increment Financing Fund, and the Savannah Bluff Lock and Dam Utility Fund, unless otherwise previously budgeted. Vote was then taken on the original motion, and the motion passed unanimously The amended ordinance text is as follows: ORDINANCE NO. 2012-17 ADOPTING A BUDGET FOR FISCAL YEAR 2013 CONTAINING ESTIMATES OF PROPOSED REVENUES AND EXPENDITURES BY THE CITY OF NORTH AUGUSTA SOUTH CAROLINA FOR THE BUDGET YEAR BEGINNING JANUARY 1, 2013, AND DECLARING THAT SAME SHALL CONSTITUTE THE BUDGET OF THE CITY OF NORTH AUGUSTA FOR SUCH BUDGET YEAR WHEREAS, in accordance with the Laws of South Carolina, and the Ordinance of the City of North Augusta, the City Administrator must prepare and submit to the City Council a Balanced Budget for the next budget year to begin on January 1, 2013, and end on December 31, 2013; and WHEREAS, a public hearing has been held on said budget, as required by law. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: Section 1. The City Council hereby adopts the 2013 Fiscal Year Budget, incorporated by reference as though it were set out herein in its entirety, for the conduct of the Minutes of Regular Meeting of 10/15/12 business of the municipal government of North Augusta for the budget year, January 1, 2013,to December 31, 2013. Section II. The transfer of budgeted amounts between functional areas of expenditures or expenses shall be approved by City Council; however, transfers of budgeted line items within the functional areas of expenditures or expenses not to exceed $5,000, may be approved by the City Administrator as long as total expenditures or expenses do not exceed appropriations in the functional area. Management can also over expend appropriations, with the City Administrator's approval, at the line item and department level, as long as the total expenditures or expenses do not exceed appropriations of the functional area. Functional areas are: General Government; Public Safety; Public Works; Recreation and Parks; Sanitation Services; Stormwater Utility; and Public Utilities. Section III. The Mayor or City Administrator may authorize the expenditure of an amount not to exceed $500 at any one time from the Council Contingencies Account without prior approval of the City Council provided that any such expenditure is reported in the minutes of the next Council meeting. Section IV. The City Council must approve expenditures from the Sales Tax I Fund, the Sales Tax II Fund, Sales Tax III Fund, the Street Improvements Fund, the Transportation Improvement Fund, the Community Development Fund, the Capital Projects Fund, the Riverfront/Central Core Development Fund, the Public Utilities Depreciation Fund, the Public Utilities Contingent Fund, Public Utilities Construction Fund, Tax Increment Financing Fund, and the Savannah Bluff Lock and Dam Utility Fund, unless otherwise previously budgeted. Section V. The City Administrator may execute all necessary documents relating to the lease purchase financing of equipment specifically authorized and identified in the 2013 Budget. The financial institution selected for 2013 lease purchase financing shall be selected based upon competitive bidding in conformance with the City's purchasing procedures. Section VI. All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section VII. This Ordinance shall become effective immediately upon its adoption on third and final reading. FINANCE: Taxes, Fiscal Year 2013 —Ordinance, First Reading On motion by Councilmember Adams, second by Councilmember Carpenter, Council unanimously passed on first reading an ordinance establishing the tax rate on all taxable property within the City of North Augusta for the Fiscal Year 2013. Minutes of Regular Meeting of 10/15/12 The period for which the tax levy is due on all taxable property, except for motorized vehicles, shall be from January 1, 2012, to December 31, 2012. The period for which the tax levy is due for all motorized vehicles which are required to be licensed by Section 53-3-110, Codes of Laws of South Carolina, shall be from January 1, 2013, to December 31, 2013. The tax levy imposed upon all taxable property shall be 74.21 mills. Revenues from 66.40 mills shall go to the General Fund. Revenues from 7.81 mills shall go to the Capital Projects Fund. The proposed ordinance text is as follows: ORDINANCE NO. 2012-18 LEVYING THE ANNUAL TAX ON PROPERTY IN THE CITY OF NORTH AUGUSTA SOUTH CAROLINA, FOR THE FISCAI YEAR BEGINNING JANUARY 1, 2013, AND ENDING DECEMBER 31, 2013 BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: Section I. PUBLIC SAFETY: Fire Protection Rates and Procedures — Ordinance, First Reading On motion by Councilmember Carpenter, second by Councilmember Adams, Council unanimously passed on first reading an ordinance amending the Code of Laws for the City of North Augusta, South Carolina and establish the procedure and rates for the City of North Augusta to provide fire protection pursuant to contract for properties lying outside of the City limits of North Augusta. The proposed ordinance text is as follows: ORDINANCE NO. 2012-19 TO AMEND THE CODE OF LAWS FOR THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA AND ESTABLISH THE PROCEDURE AND RATES FOR THE CITY TO PROVIDE FIRE PROTECTION PURSUANT TO CONTRACT FOR PROPERTIES LYING OUTSIDE OF THE CITY LIMITS OF NORTH AUGUSTA. WHEREAS, the City receives requests from property owners outside the City limits, who are not in any legally established fire district or are within a district assigned to the City, for fire protection services; and WHEREAS, the Mayor and City Council desire to provide the authority for entering into contracts for fire service as well as the proper procedure and cost for such services. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL FOR THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: 1. The Director of Public Safety is granted the authority to, at his discretion, when deemed beneficial to the City, to enter into contractual arrangements for the provision of fire protection service outside the Municipal Corporate Limits. II. The provision of such services shall be by Contract in such form as approved by the Director of Public Safety and the City Attorney. Minutes of Regular Meeting of 10/15/12 III. Prior to providing such services, the City and the land owner shall execute a written contract describing the services to be provided; the conditions under which the services will be provided; and the charge for said services. IV. The charge for provision of said services shall be $72.00 per year payable as follows: a. For those land owners who are City Water customers, the charge shall be $6.00 per month added to the monthly utility bill. b. For those land owners who are not Water customers of the City, the payment shall be $72.00 per year payable annually, in advance. PERSONNEL: Employee of the Quarter, July, August, and September, 2012—Jeremy Jiunnies The City of North Augusta Employee Recognition Committee recognized the employee of the quarter for July, August, September of 2012, Jeremy Jiunnies, Supervisor of Programs and Facilities for the Department of Parks, Recreation, & Leisure Services. Jeremy began his employment with the City of North Augusta on September 18, 1996 as a Program Coordinator. Jeremy was promoted to Activities Center Supervisor in December of 2000. In February of 2010 Jeremy became the Supervisor of Programs and Facilities. Jeremy and his wife Krista have three daughters, Brooke, Blake, and Britton. Jeremy has been an icon in the North Augusta community for the past fifteen years around the ball fields and Activities Center. He is always seen as someone who is a positive role model for kids and can always be seen mentoring troubled youth around the Activities Center. Jeremy's demeanor in a tense situation may be his biggest asset as he can calm irritable participants and fans with ease. Jeremy is the primary point of contact for the Nike Peach Jam and Nike Nationals tournaments held in July. He is the ambassador for one of the City's Minutes of Regular Meeting of 10/15/12 largest events that draws thousands of participants, fans, media, and coaches from around the nation. The economic impact of these events has been calculated over $2 million dollars to the CSRA, and Jeremy is the lead man behind the curtain for these events. It is commonplace to see NCAA coaches, officials, and media staff takes time out of their hectic schedules while they are in town to personally seek out Jeremy to express thanks for coordinating the best amateur basketball event of the year. Seth Davis of Sports Illustrated writes: "The Peach Jam was my last stop, and, as usual, it was the best event of the summer. Unlike the scene in Vegas, where coaches will be spending far more time in their rental cars than in gymnasiums, all the action at the Peach Jam took place in a single air-conditioned facility, with four games going on simultaneously." During the months of April through July it is commonplace for Jeremy to work six to seven days a week without expecting anything in return. Leading up to and during the Nike tournaments, Jeremy constantly works seventy hour weeks and synchronizes one of the most publicized events in the City. The City of North Augusta is indeed fortunate to have such a high caliber, dedicated employee like Jeremy Jiunnies. Congratulations to Jeremy Jiunnies, our Employee of the third quarter of 2012. Jeremy received a plaque, a $25 gift certificate to SMS Sportsworld, and a $25 Wal-Mart gift card. ITEM 9. When computing rates for usage above minimum, the rates shown in subsection (B) shall be on a per-meter basis. (5) Rates for multi-commercial complex: For purposes of this section, a commercial customer shall be defined as a business or industry having a separate business license, occupying separate spaces, and having separate sanitary facilities when computing the minimum charge in subsection (A) without regard to the method by which its water is metered. IL This Ordinance shall become effective immediately upon its adoption on third reading for all bills rendered on or after January 1, 2013, without regard to when the water was consumed or the meter read.
