McGhee, Councilmember 11 i ORDER OF BUSINESS REGULAR MEETING The regular meeting of July 2, 2018, having been duly publicized, was called to order by Mayor Pettit at 7:00 p.m. and adjourned at 8:12 p.m. Per Section 30-4-80(e) notice of the meeting by email was sent out to the current maintained "Agenda Mailout" list consisting of news media outlets and individuals or companies requesting notification. Notice of the meeting was also posted on the outside doors of the Municipal Center, the main bulletin board of the Municipal Center located on the first floor, and the City of North Augusta website. Mayor Pettit rendered the invocation and led in the Pledge of Allegiance. Members present were Mayor Pettit and Councilmembers Adams, Brooks, Carpenter, Dickert, McDowell, and McGhee. Also in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney; Cammie T. Hayes, Director of Finance; John C. Thomas, Director of Public Safety; Thomas C. Zeaser, Director of Engineering and Public Works; Lillian E. (Libby) Hodges, Director of Minutes of Regular Meeting of 07/02/18 Planning and Development; Diana H. Miller, Manager of Human Resources; and J. D. McCauley, Manager of Human Resources effective August 1, 2018. The minutes of the regular meeting of June 4, 2018 and the regular and study session minutes of June 18, 2018 were approved by general consent. ITEM 1. ZONING: Ordinance No. 2018-05 — An Ordinance Amendin' Article 3 Zoning Districts, Related to the Boundaries of the Neighborhood Preservation Overlay District, of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances — Remove from Table On motion by Councilmember Brooks, second by Councilmember Carpenter, the ordinance amending Article 3, Zoning Districts, related to the boundaries of the Neighborhood Preservation Overlay District of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances was considered for removal from the table for consideration on first reading. Voting for the removal of the ordinance from the table were: Mayor Pettit and Councilmembers Brooks, Carpenter, and McGhee. Voting against the removal of the ordinance from the table were Councilmembers Adams, Dickert, and McDowell. The motion passed with a 4/3 vote. ITEM 2. ZONING: Ordinance No. 2018-05 — An Ordinance Amending Article 3, Zoning Districts, Related to the Boundaries of the Neighborhood Preservation Overlay District, of the North Augusta Development Code, Chapter 18 of the City of North Augusta,South Carolina Code of Ordinances — Ordinance, First Reading On motion by Councilmember Carpenter, second by Councilmember Brooks, Council passed an ordinance on first reading amending Article 3, Zoning Districts, related to the boundaries of the Neighborhood Preservation Overlay District of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances. Voting for the ordinance on first reading were: Mayor Pettit and Councilmembers Brooks, Carpenter, and McGhee. Voting against the ordinance on first reading were Councilmembers Adams, Dickert, and McDowell. The ordinance passed on first reading with a 4/3 vote. Minutes of Regular Meeting of 07/02/18 At the request of and on motion by Councilmember McDowell, second by Councilmember Adams, second reading was delayed and not had at the July 2, 2018 meeting. ORDINANCE NO. 2018-05 AMENDING ARTICLE 3, ZONING DISTRICTS, RELATED TO THE BOUNDARIES OF THE NEIGHBORHOOD PRESERVATION OVERLAY DISTRICT, OF THE NORTH AUGUSTA DEVELOPMENT CODE, CHAPTER 18 OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA CODE OF ORDINANCES WHEREAS, on December 17, 2007, by Ordinance 2007-22, the North Augusta City Council adopted the North Augusta Development Code which is consistent with the City's Comprehensive Plan and which incorporates all City zoning and land development regulations; and WHEREAS, pursuant to Title 6, Chapter 29 of the South Carolina Code, the North Augusta Planning Commission may review requests for amendments to zoning ordinances; and WHEREAS, pursuant to Section 5.3.3.1 Rezonings and Text Amendments in Article 5, Approval Procedures, of the North Augusta Development Code, any property owner, city hoard, commission, department or the City Council may apply for a change in zoning district boundaries; and WHEREAS, the North Augusta Planning Commission, following a March 15, 2018 public hearing, reviewed and considered a request by Mountaineer Pest Services to amend Section 3.8.2; Establishment of Corridor Overlay Districts, in Article 3, Zoning Districts, of the North Augusta Development Code to change the boundaries of the Neighborhood Preservation Overlay District. The Planning Commission report has been provided to City Council. The Mayor and City Council have reviewed the request as well as the report from the Planning Commission arid has determined that the change to the boundaries of the Neighborhood Preservation Overlay District is appropriate. FINANCE: Resolution No. 2018-15 — A Resolution Authorizing the City of North Augusta to Accept the Low Bid from Talbot Tennis for the Maude Edenfield Park Tennis Courts Restoration On motion by Councilmember Brooks, second by Councilmember Carpenter, Council unanimously passed a resolution authorizing the City of North Augusta to accept the low bid from Talbot Tennis for the Maude Edenfield Park tennis courts restoration. RESOLUTION NO. 2018-15 A RESOLUTION AUTHORIZING THE CITY OF NORTH AUGUSTA TO ACCEPT THE LOW BID FROM TALBOT TENNIS FOR THE MAUDE EDENFIELD PARK TENNIS COURTS RESTORATION WHEREAS, on October 11, 2016, the City of North Augusta was selected to receive federal assistance funding of $91,025 provided by the National Park Service in accordance with the Land and Water Conservation Fund for the purpose of financing the cost of the Maude Edenfield Tennis Court Restoration Project; and WHEREAS, on November 20, 2017, the City approved funding for the Maude Edenfield Tennis Courts Restoration during the 2018 budget process from the Capital Projects Fund of$184,000; and WHEREAS, ON May 31, 2018, sealed bids were received, publicly opened and read aloud for the PROJECT; and WHEREAS, the low bid by Talbot Tennis, Marietta, Georgia is in the amount of $241,590; and Minutes of Regular Meeting of 07/02/18 WHEREAS, after negotiations through value engineering an offer of $209,580 was offered by Talbot Tennis; and WHEREAS, Parks, Recreation, & Tourism requests to use a portion of the funding for the tennis courts at Riverview Park of $25,580 from the Riverfront/Central Core Redevelopment Fund in the 2018 budget; and WHEREAS, the Mayor and City Council of the City of North Augusta find that the awarding of such bid for the PROJECT is in the best interest of the City. NOW THEREFORE BE IT RESOLVED by the Mayor and City Council for the City of North Augusta in meeting duly assembled and by the authority thereof that Talbot Tennis shall be awarded the contract for Maude Edenfield Tennis Courts at a total cost of$209,580. FOIA Request We have been trying to get information relating to Neighborhood Preservation Overlay District issues since early May. We have not received the responsive documents from the City,to our knowledge, to date. And, we have cooperated to even narrow our initial requests. The lack of response by the City is likely to violate the South Carolina Freedom of Information Act, and it inhibits our ability to participate in the process. Before proceeding with an amendment to the Neighborhood Preservation Overlay District, please supply documents responsive to our FOIA request. Conflicts of Interest The Ethics Act, SC Code §8-13-700 provides in part: SECTION 8-13-700.Use of official position or office for financial gain; disclosure of potential conflict of interest. Rezoning, Not a Text Amendment As always, please understand that it is our fundamental view that decisions to revise the Neighborhood Preservation Overlay District is a rezoning, not a text amendment. And, it deserves the process and attention of a rezoning. We further believe that such significant planning decisions, affecting others than the applicant, should be made in consultation with the planning department. It should be made in the context of, and consistent with, the Comprehensive Plan and other applicable laws. Furthermore, It should be done with all interested people at the table and given a voice.
