Whinghter, Councilmember ORDER OF BUSINESS REGULAR MEETING The regular meeting of June 4, 2012, having been duly publicized, was called to order by Mayor Jones at 7:00 p.m. Mayor Jones rendered the invocation and led in the Pledge of Allegiance. Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, and Whinghter. Councilmembers Adams and Shealy were absent. Also in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney; John P. Potter, Jr., Director of Finance; Scott L. Sterling, Interim Director of Planning and Economic Development; John C. Thomas, Director of Public Safety; Thomas C. Zeaser, Director of Engineering and Public Works; James E. Sutton, Deputy Director of Public Services; Diana H. Miller, Manager of Human Resources; and Donna B. Young, City Clerk. Minutes of Regular Meeting of 6/04/12 The minutes of the study session and regular meetings of May 21, 2012, were approved by general consent. ITEM 1 ZONING• North Augusta Development Code, Proposed Text Amendments (Application RZT 12-001) — Ordinance, Third and Final Reading On motion by Councilmember Baggott, second by Councilmember McDowell, Council unanimously adopted an ordinance on third and final reading amending Article 9, Floodplain Management, and portions of Article 3, Zoning Districts and Appendix A, Definitions, related to Floodplain Management, of the North Augusta Development Code, Chapter 18 of the City of North Augusta, South Carolina Code of Ordinances. Please see the minutes of May 7 and 21, 2012, for the proposed ordinance text. ITEM 2 CITY PROPERTY: Deed of Easement Across 1.09 +/- Acres of Property to Aiken County—Ordinance, Third and Final Reading On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously adopted an ordinance on third and final reading to deed an easement across 1.09 acres of property to Aiken County. Please see the minutes of May 21, 2012 for the proposed ordinance text. ITEM 3. CITY PROPERTY: Agenda Addition Upon request of the City Attorney, on motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously voted to add to the regular agenda of June 4, 2012, a proposed ordinance granting two easements across property belonging to the City to the South Carolina Department of Transportation. ITEM 4. CITY PROPERTY: Granting Two Easements Across Property Belonging to the City to the South Carolina Department of Transportation — Ordinance, First Reading On motion by Councilmember McDowell, second by Councilmember Baggott, Council unanimously passed an ordinance on first reading to grant two easements across property belonging to the City of North Augusta to the South Carolina Department of Transportation. The proposed ordinance text is as follows: Minutes of Regular Meeting of 6/04/12 ORDINANCE NO. 2012-10 TO GRANT TWO EASEMENTS ACROSS PROPERTY BELONGING TO THE CITY TO THE SOUTH CAROLINA DEPARTMENT OF TRANSPORTATION. WHEREAS, the South Carolina Department of Transportation (hereinafter "SCDOT") in coordination with the City of North Augusta (hereinafter "the City) is making roadway improvements at the intersection of Five-Notch Road and Pisgah Road; and, WHEREAS, in order for the improvements to be completed as designed, it is necessary that the City grant two different easements over property in the area of the improvements that is currently titled to the City of North Augusta; and, Whereas, the City has determined that such request is a proper request by the SCDOT and is intended to provide roadway improvements that will benefit the general public. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT: The City of North Augusta does hereby remise, convey and forever grant to the South Carolina Department of Transportation easements across property belonging to the City. Said easements are described as follows: Easement 1: All that certain parcel of land containing, 0.30 of an acre (13,003.30 square feet), more or less, and all improvements thereon, if any, owned by The City of North Augusta, A Municipal Corporation, shown as the Area of Acquisition on Exhibit "A", attached hereto and made a part hereof. This being a portion of the property acquired from Bishop F. Strickland a/ka F. Bishop Strickland by Deed dated June 12, 1989 and recorded July 3, 1989 in Deed Book 1107, at Page 337 in the records of the ROD Office for Aiken County and shown as Tax Map No. 005-19- 03-002. Said property is located in Aiken County. Easement 2: All that certain parcel of land containing, 0.03 of an acre (1105.57 square feet), more or less, and all improvements thereon, if any, owned by The City of North Augusta, A Municipal Corporation, shown as the Area of Acquisition on Exhibit "B", attached hereto and made a part hereof. This being a portion of the property acquired from Bishop F. Strickland a/ka F. Bishop Strickland by Deed dated June 12, 1989 and recorded July 3, 1989 in Deed Book 1107, at Page 337 in the records of the ROD Office for Aiken County and shown as Tax Map No. 005-19-03-001. Said property is located in Aiken County. Minutes of Regular Meeting of 6/04/12 The City Administrator is authorized to execute such documents as necessary to complete this transaction. All other ordinances or parts of other ordinances in conflict herewith are to the extent of such conflict, hereby repealed. This Ordinance shall become effective immediately upon its adoption on third and final reading. DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS DAY OF JUNE, 2012. ITEM 5 CITY PROPERTY: Granting Two Easements Across Property Belonging to the City to the South Carolina Department of Transportation — Ordinance, Second Reading On motion by Mayor Jones, second by Councilmember Whinghter, Council unanimously passed an ordinance on second reading to grant two easements across property belonging to the City of North Augusta to the South Carolina Department of Transportation.
