ORDER OF BUSINESS
REGULAR MEETING
The regular meeting of April 2„ 2012, having been duly publicized, was called to order by
Mayor Jones at 7:00 p.m. Mayor Jones rendered the invocation and led in the Pledge of
Allegiance.
Members present were Mayor Jones and Councilmembers Adams, Baggott, Carpenter,
Whinghter, and Shealy. Councilmember McDowell was absent.
Also in attendance were B. Todd Glover, City Administrator; Kelly F. Zier, City Attorney;
Richard L. Meyer, Interim Director of Parks, Recreation, and Leisure Services; Scott L. Sterling,
Interim Director of Planning and Economic Development; John C. Thomas, Director of Public
Safety; Thomas C. Zeaser, Director of Engineering and Public Works; James E. Sutton, Deputy

The minutes of the study session and regular meetings of March 19, 2012, were approved by
general consent.
ITEM 1. STREETS AND DRAINS: Charleston Place, Deed of Dedication for
Subdivision Improvements—Resolution
On motion by Councilmember Shealy, second by Councilmember Carpenter, a
motion accepting a deed of dedication for a ten foot utility easement, along with a
maintenance guarantee and a deposit to support the maintenance guarantee for
Charleston Place by resolution was passed by Mayor and Council. Voting for the
motion were Councilmembers Adams, Baggott, Carpenter, Shealy, and
Whinghter. Mayor Jones recused himself because he is professionally employed
by or under contract with the principal.

RESOLUTION NO. 2012-07
ACCEPTING A DEED OF DEDICATION FOR A TEN FOOT UTILITY EASEMENT,
ALONG WITH A MAINTENANCE GUARANTEE AND A DEPOSIT TO SUPPORT THE
MAINTENANCE GUARANTEE, FOR CHARLESTON PLACE
WHEREAS, Kenneth A. Newsome and Charles Terry Olson dba Riverdale Real
Estate Alliance, Inc., developed Charleston Place according to the requirements of the North
Augusta Planning Commission and the City; and
WHEREAS, pursuant to §5.8.4.3 of the North Augusta Development Code, the
Interim Director of Planning and Economic Development and the City Engineer approved the
final subdivision plat for recording on March 15, 2012; and
WHEREAS, it is the policy of the City that, upon approval of a final subdivision
plat, the City will, following inspection by the City's Engineering department, accept a deed of
dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said
deed is accompanied by a maintenance guarantee; and
WHEREAS, a maintenance guarantee supported by a $300 deposit from K.A.
Newsome & Co., Inc., in lieu of a letter of credit, accompany the deed; and
WHEREAS, the City Engineer has made final inspection of the subject
improvements, and these improvements meet City standards.

NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the
City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof,
do hereby accept a deed of dedication for:
A ten foot (10') utility easement situate, lying and being in the City of North
Augusta, Aiken County, South Carolina, being and shown and designated on a
plat of Charleston Place in Hammond's Ferry by Toole Surveying dated April 13,
2011 and revised February 8, 2012 and recorded in the Aiken County RMC
Office in Plat Book 56 at page 75. For a more specific description, reference
shall be made to the aforesaid plat which is made a part and parcel hereof.
This is the identical property conveyed to Kenneth A. Newsome and Charles
Terry Olson by deed recorded in Deed Book 4186 at page 2258.

BE IT FURTHER RESOLVED that a Maintenance Guarantee and a deposit in
the amount of$300 are hereby accepted.

ITEM 2. ZONING: 0.60 +/- Acres Near the Intersection of Old Edgefield Road
and Weston Street — R-10, Medium Lot, Single-Family Residential, to NC,
Neighborhood Commercial; Aiken County Tax Parcel Numbers 007-12-003-
001 and 007-12-003-002 — Planning Commission Recommendation — Receipt
by Council, Motion To Receive
On motion by Councilmember Baggott, second by Mayor Jones, Council
unanimously received the March 15, 2012, Planning Commission
recommendation of the approval of Application Number RZM 12-001, a request
by Eunice Carr to rezone 0.60 + acres located near the intersection of Old
Edgefield Road and Weston Street, Aiken County Tax Parcel Numbers 007-00-
003-001 and 007-12-003-002 from R-10, Medium Lot, Single-Family
Residential, to NC,Neighborhood Commercial.
The purpose of the rezoning request is to expand the potential permitted uses to
include single-family attached residential, small-scale commercial uses and
professional offices with the possibility of combining the two parcels to be
marketed for future commercial development.

and Weston Street — R-10, Medium Lot, Single-Family Residential, to NC,

On motion by Mayor Jones, second by Councilmember Carpenter, Council
unanimously passed an ordinance on first reading to affect the requested rezoning
of 0.60 +/- acres located near the intersection of Old Edgefield Road and Weston
Street, Aiken County Tax Parcel Numbers 007-00-003-001 and 007-12-003-002
from R-10, Medium Lot, Single-Family Residential, to NC, Neighborhood
Commercial.

TO AMEND THE ZONING MAP OF THE CITY OF NORTH AUGUSTA,
SOUTH CAROLINA BY REZONING TWO PARCELS OF LAND TOTALING±0.60
ACRES OWNED BY EUNICE CARR AND LOCATED NEAR THE INTERSECTION OF
OLD EDGEFIELD ROAD AND WESTON STREET, TAX PARCEL NUMBERS 007-12-03-
001 AND 007-12-03-002 FROM R-10 MEDIUM LOT SINGLE-FAMILY RESIDENTIAL
TO NC NEIGHBORHOOD COMMERCIAL
WHEREAS, on December 17, 2007, by Ordinance 2007-22, the North Augusta
City Council adopted the North Augusta Development Code and a citywide Zoning Map which
is consistent with the City's 2005 Comprehensive Plan; and
WHEREAS, pursuant to Section 5.3, North Augusta Development Code, the
North Augusta Planning Commission may recommend amendments to the Zoning Map,
provided such amendments are consistent with the City's 2005 Comprehensive Plan; and
WHEREAS, the North Augusta Planning Commission, following a March 15,
2012 public hearing, reviewed, considered and approved an amendment to the Zoning Map and
recommended said amendment to the City Council for approval.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING
DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
1. The property, two parcels owned by Eunice Carr and near the intersection of Old
Edgefield Road and Weston Street, containing ±0.60 acres and shown on the
map prepared by the City of North Augusta dated February 22, 2012 and attached
hereto as Exhibit A, is hereby rezoned from R-10, Medium Lot, Single-Family
Residential, to NC, Neighborhood Commercial. The subject property is
identified by the following Aiken County Tax Map Block and Parcel Numbers:

007-12-03-002
II. Said property being officially rezoned to the classification NC, Neighborhood
Commercial, in accordance with the map attached hereto as Exhibit A, the
official Zoning Map of the City of North Augusta is to be so amended.

III. All ordinances or parts of Ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
IV. This Ordinance shall become effective immediately upon its adoption on third
and final reading.

12-003-002 from R-10, Medium Lot, Single-Family Residential, to NC,
Neighborhood Commercial.
