Baggott, Councilmember Pat C. Carpenter, Councilmember Kenneth J. McDowell, Councilmember Arthur H. Shealy, Councilmember Jason M. Whinghter, Councilmember ORDER OF BUSINESS The study session meeting of March 5, 2012, having been duly publicized, was called to order by Mayor Jones at 6:15 p.m. in the Council Conference room on the third floor of the Municipal Center. The meeting recessed and reconvened following the regular Council meeting. Members present were Mayor Jones and Councilmembers Adams, Baggott, Carpenter, Shealy, and Whinghter. Councilmember McDowell was out of town due to work responsibilities. Also in attendance were B. Todd Glover, City Administrator; John P. Potter, Jr., Director of Finance; Richard L. Meyer, Interim Director of Parks, Recreation, and Leisure Services; Scott L. Sterling, Interim Director of Planning and Economic Development; John C. Thomas, Director of Public Safety; Thomas C. Zeaser, Director of Engineering and Public Works; James E. Sutton, Deputy Director of Public Services; Diana H. Miller, Manager of Human Resources; and Donna B. Young, City Clerk. Richard L. Meyer, Interim Director of Parks, Recreation, and Leisure Services, John C. Thomas, Director of Public Safety, and Diana H. Miller, Manager of Human Resources were excused from the executive session. ITEM 1. ECONOMIC DEVELOPMENT: Sale of Alcohol on Sunday — Request to Place Question on November Ballot Upon the request of Brian Tucker, President and CEO, of the Greater North Augusta Chamber of Commerce, Mayor and Council discussed placing the question of Sunday alcohol sales on the November ballot. City Attorney, Kelly F. Zier, advised Mayor and Council that according to state law that the referendum can only be placed on the ballot at the General Election. Pursuant to City Minutes of Study Session of 03/05/12 ordinance, the general election for the City of North Augusta shall be held on the last Tuesday in April. After discussion, it was the general consensus of Mayor and Council, that this item should be put on hold for two weeks and that Mr. Tucker should get in touch with the Legislative Delegation of Aiken County to discuss the feasibility of redefining the general election and splitting the referendum questions. ITEM 2. PLANNING: Proposed Georcia Avenue Overlay District Text Amendment Options—Council Update and Review Interim Director of Planning and Economic Development, Scott L. Sterling, updated Mayor and Council on the proposed Georgia Avenue Overlay District Text Amendment Options and staff recommendations. Mayor Jones asked Mr. Sterling to draft language to include a 24 month grace period for all nonconforming uses within the Georgia Avenue Overlay District for further review by Mayor and Council at a future study session. ITEM 3. LEGAL: Executive Session—Request of the City Administrator Upon the request of the City Administrator and in accordance with Section 30-4- 70 (a) (2) and on motion by Councilmember Baggott, second by Councilmember Carpenter, City Council unanimously voted to go into executive session for the purpose of discussion of negotiations incident to two proposed contractual arrangements. On motion by Mayor Jones, second by Councilmember Adams, the executive session was adjourned. There was nothing to report out.
