RES 2014-21 Adopted RESOLUTION NO. 2014-21 AUTHORIZING THE CITY TO ENTER INTO A CONTRACT/DEVELOPMENT AGREEMENT WITH SPS NORTH AUGUSTA, LLC, FOR THE CONSTRUCTION OF AN OFFICE BUILDING GARAGE ON PROPERTY BELONGING TO THE CITY LOCATED ON APPROXIMATELY 1.51 ACRES BETWEEN CENTER STREET AND AN UNDEVELOPED PORTION OF WEST AVENUE. WHEREAS, the City has previously agreed to provide parking related to an office building being constructed by Greenstone NG, LLC for occupancy by MEDAC, Inc.; and, WHEREAS, for the purpose of meeting its responsibility to provide the parking deck, the City issued a request for qualifications with respect to design build services for construction of office parking garage, as well as other possible parking garages; and, WHEREAS, following a review of the submitted qualifications, the City determined that SPS, North Augusta, LLC was qualified to provide the services on the time schedule required; and, WHEREAS, thereafter, the City has negotiated a contract with SPS North Augusta, LLC for the construction of the single office building garage; and, WHEREAS, the Mayor and City Council have reviewed the contract/development agreement and find that it is appropriate and in the best interest of the City that such contractual arrangement be entered into. NOW TIIEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof authorize the City Administrator to enter into such contract with SPS North Augusta, LLC, as attached hereto. Be it further resolved that the funding for such contract will be from tax increment financing. Be it further resolved that the City Administrator and City Attorney are authorized to agree to such text changes in the document as they determine to be necessary to further clarify such document and protect the interest of the City.
