ORD 2014-04 Adopted ORDINANCE NO. 2014-04 TO CHANGE THE CORPORATE LIMITS OF THE CITY OF NORTH AUGUSTA BY ANNEXING±4.35 ACRES OF PROPERTY LOCATED AT 115 LAUREL LAKE DRIVE AND OWNED BY CIRCLE K STORES, INC. WHEREAS, Section 5-3-150(3) of the Code of Laws of the State of South Carolina provides that: "Notwithstanding the provisions of subsections (1) and (2) of this section, any area or property which is contiguous to a municipality may be annexed to the • municipality by filing with the municipal governing body a petition signed by all persons owning real estate in the area requesting annexation. Upon the agreement of the governing body to accept the petition and annex the area, and the enactment of an ordinance declaring the area annexed to the municipality, the annexation is complete"; and WHEREAS, the Mayor and City Council of the City of North Augusta, by adoption of Resolution No. 2014-05 dated March 3, 2014, accepted a Petition for Annexation and wish to annex the below described properties; and WHEREAS, the zoning classification recommended for the properties proposed for annexation has been reviewed for consistency with the Future Land Use Classification of the properties as specified in the Land Use Element of the 2005 Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof that: I. The following described properties shall be annexed into the City of North Augusta: All that tract and parcel of land, together with improvements thereon, situated and being in the County of Aiken, State of South Carolina, being and shown and designated upon a plat by Joe L. Grant, Registered Land Surveyor on March 3, 1983, recorded in the Office of the RMC of Aiken County, South Carolina in Plat Book 14,page 3 and being more particularly described as follows: Beginning at a 2"open top pipe with a cap found on the east line of Frontage Road #1 (60' public right of way), said point being the northwest corner of the parcel of the land designated upon said survey plat recorded in Plat Book 14, page 3; Thence,N76° 31'00"E, along the south line of lands conveyed to South Carolina Electric and Gas Company, 275.67 feet to a 2" open top with cap found; Thence, along the south line of said Gas Company lands, S68° 36'45"E, 366.43 feet to a 2" open top with cap found, on the east line of lands conveyed to Akers Motor Lines; ORDINANCE NO. 2014-04 Page 2 Thence, along said Akers lands, S08°37'25"E, 391.67 feet to a 1" open top found; Thence,N59°27'50"W, 20.25 feet to a 1 1/2" open top found; Thence, S08°17'41"E, 30.00 feet to a 1 1/2" open top found on the east line of said Frontage Road#1; Thence, along the east line of said Road, N61° 05'25"W, 636.54 feet to a 5/8" rebar found at a point of curvature; Thence, northwesterly, 190.01 feet along the arc of a curve to the right, having a radius of 118.11 feet, a chord of 182.03 feet, bearing N32°09'11"W and a Delta of 57°52'28",to a concrete monument found; Thence, NO3°12'58"W, 14.18 feet to the place of beginning containing 4.3483 acres (189,410 square feet) of land. Said tract being a part of the same property conveyed to Circle K Stores Inc. by deed recorded in Book 2390, pages 47-57, records of Aiken County, South Carolina. Tax Parcel Number 010-18-01-001 The property to be annexed is also shown on a map identified as "Exhibit A" titled"Map of Property Sought to be Annexed to the City of North Augusta" dated February 18, 2014, and prepared by the City of North Augusta. II. The zoning classification recommended for the properties to be annexed is consistent with the Future Land Use Classification of the properties as specified in the Land Use Element of the 2005 Comprehensive Plan; therefore, the properties shall be zoned GC/HC, General Commercial in the Highway Corridor Overlay District, as shown on a map identified as "Exhibit B" titled "ANX 014- 001 Zoning of Property Sought to Be Annexed to the City of North Augusta" dated February 18, 2014 and prepared by the City of North Augusta. III. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. IV. This Ordinance shall become effective immediately upon its adoption on third and final reading.
