RES 2013-05 Adopted TIFRESOLUTION NO. 2013 -05 ACCEPTING A DEED OF DEDICATION FOR THE STREETS, SIDEWALKS, SANITARY SEWER AND STORMWATER COLLECTION SYSTEMS AND ASSOCIATED EASEMENTS, ALONG WITH A MAINTENANCE GUARANTEE AND LETTER OF CREDIT, FOR WANDO WOODLANDS, PHASE TWO -B WHEREAS, Wando Partners, L.P. developed Wando Woodlands, Phase Two -B according to the requirements of the North Augusta Planning Commission and the City, and owns the streets, sidewalks, utilities, and easements; and WHEREAS, pursuant to §5.8.4.3 of the North Augusta Development Code, the Interim Director of Planning and Economic Development and the City Engineer approved the final subdivision plat for recording on November 21, 2012; and WHEREAS, it is the policy of the City that, upon approval of a final subdivision plat, the City will, following inspection by the City's Engineering department, accept a deed of dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said deed is accompanied by a maintenance guarantee; and WHEREAS, a maintenance guarantee and letter of credit accompany the deed; and WHEREAS, the City Engineer has made final inspection of the subject improvements, and these improvements meet City standards. NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for: ALL that certain street and roadway located in Wando Woodlands Two B designated as a portion of Gustav Court (50 foot right of way) together with the area labeled "Proposed Detention Facility to be Deeded to the City of North Augusta," "Open Space to be Deeded to the City of North Augusta" containing 13.16 acres and "Section 2B 50'Stream Buffer Area to be Deeded to the City" containing 3.38 acres as shown and delineated upon a plat of Wando Woodlands Phase Two B prepared by Southern Partners, Inc. for Wando Partners, LP dated October 23, 2012, and revised November 5, 2012, recorded November 27, 2012 in Plat Book 56, Page 922, Aiken County Records. Reference is made to said plat for a more accurate and complete description of the metes and bounds of the subject property. TOGETHER WITH all (a) curbs and gutters located within the aforesaid right of way of the streets and roadways; (b) sidewalks located within the aforesaid right of way of the streets and roadways; (c) sanitary sewerage RESOLUTION ACCEPTING DEED OF DEDICATION — WANDO WOODLANDS, PHASE TWO -B Page 2 collection system including lift stations located on the property shown on the aforesaid plat; (d) stormwater collection system including stormwater detention areas located on the property shown on the aforesaid plat; (e) greenways or other pedestrian connections outside the road rights -of -way but located on the property shown on the aforesaid plat; and (f) a perpetual and non - exclusive easement and rights -of -way for streets, sidewalks and potable water, sanitary sewage and stormwater collection systems located on the property shown on the aforesaid plat. Derivation: BEING a portion of the property conveyed to Wando Partners, LP by deed of Gustav Schickedanz, Trustee dated January 4, 2006 and recorded January 6, 2006 in Record Book 4039, Page 1283, Aiken County Records. Tax Parcel Number 001 -16 -01 -002 (Portion) BE IT FURTHER RESOLVED that a Maintenance Guarantee and Letter of Credit valued at $71,000 are hereby accepted.
